{"id":28468,"date":"2022-09-07T13:53:23","date_gmt":"2022-09-07T11:53:23","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/ferie-non-godute-perse-se-il-lavoratore-non-adempie-linvito-del-datore-a-fruirne-norme-tributi-plus-diritto-de-il-sole-24-ore-7-settembre-2022-alberto-de-luca-luca-cairoli-2\/"},"modified":"2026-02-16T16:35:25","modified_gmt":"2026-02-16T15:35:25","slug":"ferie-non-godute-perse-se-il-lavoratore-non-adempie-linvito-del-datore-a-fruirne-norme-tributi-plus-diritto-de-il-sole-24-ore-7-settembre-2022-alberto-de-luca-luca-cairoli","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/ferie-non-godute-perse-se-il-lavoratore-non-adempie-linvito-del-datore-a-fruirne-norme-tributi-plus-diritto-de-il-sole-24-ore-7-settembre-2022-alberto-de-luca-luca-cairoli\/","title":{"rendered":"Cong\u00e9s non utilis\u00e9s perdus si le travailleur n\u2019obtemp\u00e8re pas suite \u00e0 l\u2019invitation de son employeur \u00e0 en b\u00e9n\u00e9ficier (Norme &#038; Tributi Plus Diritto de Il Sole 24 Ore, 7 septembre 2022 \u2013 Alberto De Luca, Luca Cairoli)"},"content":{"rendered":"\n<p><em>Dans l\u2019optique de la Cour de cassation, le droit \u00e0 l\u2019indemnit\u00e9 substitutive des cong\u00e9s non utilis\u00e9s, lors de la rupture du<br>contrat de travail, serait intrins\u00e8quement li\u00e9 au droit aux cong\u00e9s pay\u00e9s annuels<\/em><\/p>\n\n\n\n<p>Par son arr\u00eat n\u00b0 21781\/2022, publi\u00e9 le 8 juillet dernier, la Cour de cassation, chambre du travail, s\u2019est prononc\u00e9e (ainsi que sur diff\u00e9rentes autres questions en mati\u00e8re d\u2019emploi public) sur un th\u00e8me largement d\u00e9battu en doctrine et en jurisprudence, \u00e0 savoir la question relative aux limites au droit du travailleur de recevoir une indemnit\u00e9 mon\u00e9taire substitutive des cong\u00e9s au moment de la cessation de son contrat de travail, au cas o\u00f9 il ne les aurait pas utilis\u00e9s en nature.&nbsp;<\/p>\n\n\n\n<p>Comme on le sait, le droit du travailleur \u00e0 b\u00e9n\u00e9ficier de cong\u00e9s pay\u00e9s annuels est directement pr\u00e9vu par l\u2019art. 36, alin\u00e9a 3, de notre Constitution, lequel ajoute que celui-ci \u00ab ne peut y renoncer \u00bb. Le droit aux cong\u00e9s est \u00e9galement r\u00e9gi par le Code civil, \u00e0 l\u2019art. 2109, et par le d\u00e9cret l\u00e9gislatif du 8.4.2003 n\u00b0 66, lesquels confirment l\u2019impossibilit\u00e9 de renoncer au droit aux cong\u00e9s pay\u00e9s ainsi que l\u2019interdiction de les remplacer par une indemnit\u00e9 mon\u00e9taire substitutive, si ce n\u2019est en cas de r\u00e9siliation du contrat de travail.&nbsp;<\/p>\n\n\n\n<p>Pour mieux comprendre cet arr\u00eat, relatif \u00e0 un contrat de travail d\u2019une administration publique, il convient \u00e9galement de citer l\u2019art. 5, alin\u00e9a 8, du d\u00e9cret l\u00e9gislatif du 6 juillet 2012 n\u00b0 95, converti avec modifications en la loi du 7 ao\u00fbt 2012 n\u00b0 135, selon lequel les cong\u00e9s, les repos et les permis auxquels a droit le personnel des administrations publiques comprises dans le compte \u00e9conomique consolid\u00e9 de l\u2019administration publique doivent obligatoirement \u00eatre utilis\u00e9s et ne donnent en aucun cas lieu au versement de sommes substitutives, m\u00eame en cas de cessation du contrat de travail.&nbsp;<\/p>\n\n\n\n<p>Le cas soumis \u00e0 la Cour de cassation opposait la R\u00e9gion des Abruzzes et une travailleuse qui, en premi\u00e8re instance, avait obtenu gain de cause par-devant le tribunal du travail de l\u2019Aquila, lequel avait accueilli sa demande en d\u00e9clarant la nature subordonn\u00e9e de son lien de travail avec la R\u00e9gion, constitu\u00e9 d\u2019une s\u00e9rie de contrats de collaboration coordonn\u00e9e et continue stipul\u00e9s entre 2002 et 2010, ainsi que son droit au paiement des diff\u00e9rences de r\u00e9tribution.&nbsp;<\/p>\n\n\n\n<p>La Cour d\u2019appel de l\u2019Aquila, r\u00e9formant le jugement contest\u00e9, avait d\u00e9duit du montant des diff\u00e9rences de r\u00e9tribution apur\u00e9es par le tribunal les sommes calcul\u00e9es comme indemnit\u00e9 substitutive des cong\u00e9s et des permis non utilis\u00e9s par la travailleuse.&nbsp;<\/p>\n\n\n\n<p>Dans ses motifs, la Cour d\u2019appel, rappelant des arr\u00eats ant\u00e9rieurs de la Cour de cassation (Cass. n\u00b0 10701\/2015 ;&nbsp;Cass. n\u00b0 8791\/2015 et Cass. n\u00b0 4855\/2014), consid\u00e9rait que le travailleur demandant en justice le versement d\u2019une indemnit\u00e9 substitutive des cong\u00e9s avait une double charge de la preuve, portant respectivement sur : (i) l\u2019ex\u00e9cution de sa prestation de travail pendant les jours destin\u00e9s aux cong\u00e9s ; (ii) le fait que l\u2019absence de jouissance de ces cong\u00e9s \u00e9tait due \u00e0 des exigences de service exceptionnelles et motiv\u00e9es ou \u00e0 une cause de force majeure.&nbsp;<\/p>\n\n\n\n<p>Sur le premier point, peut-on lire dans l\u2019arr\u00eat en objet, la d\u00e9cision de la Cour d\u2019appel de l\u2019Aquila semble conforme \u00e0 la jurisprudence consolid\u00e9e selon laquelle le travailleur agissant en justice pour demander le versement de l\u2019indemnit\u00e9 substitutive des cong\u00e9s non utilis\u00e9s a la charge de prouver l\u2019ex\u00e9cution de sa prestation de travail pendant les jours destin\u00e9s aux cong\u00e9s, \u00e9tant donn\u00e9 que l\u2019exercice de l\u2019activit\u00e9 professionnelle en plus de la p\u00e9riode annuelle normale de travail effectif est un \u00e9l\u00e9ment constitutif de l\u2019indemnit\u00e9 susmentionn\u00e9e.
