{"id":28474,"date":"2022-10-31T08:50:24","date_gmt":"2022-10-31T07:50:24","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/circolare-ministero-del-lavoro-no-19-del-20-settembre-2022-nuovi-chiarimenti-sul-decreto-trasparenza-3\/"},"modified":"2026-04-08T14:44:10","modified_gmt":"2026-04-08T12:44:10","slug":"circolare-ministero-del-lavoro-no-19-del-20-settembre-2022-nuovi-chiarimenti-sul-decreto-trasparenza","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/circolare-ministero-del-lavoro-no-19-del-20-settembre-2022-nuovi-chiarimenti-sul-decreto-trasparenza\/","title":{"rendered":"Circulaire du Minist\u00e8re du Travail n\u00b0 19 du 20 septembre 2022 : nouvelles pr\u00e9cisions sur le d\u00e9cret \u00ab Transparence \u00bb"},"content":{"rendered":"\n<p>Dans une optique de raccord avec les indications d\u00e9j\u00e0 fournies par l\u2019Inspection Nationale du Travail (circulaire n\u00b0 4 du 10 ao\u00fbt 2022), le Minist\u00e8re du Travail, par la circulaire en objet, est intervenu afin d\u2019\u00e9claircir et de pr\u00e9ciser ult\u00e9rieurement la port\u00e9e des nouvelles obligations d\u2019information introduites par le d\u00e9cret l\u00e9gislatif n\u00b0 104 du 27 juin 2022 (dit \u00ab D\u00e9cret Transparence \u00bb).<\/p>\n\n\n\n<p>Comme la circulaire de l\u2019I.N.T. n\u00b0 4\/2022 l\u2019a d\u00e9j\u00e0 pr\u00e9cis\u00e9, l\u2019employeur est \u00e0 pr\u00e9sent tenu de fournir au travailleur les informations de base relatives \u00e0 tous les \u00e9l\u00e9ments du contrat de travail indiqu\u00e9s au nouvel article 1 du d\u00e9cret l\u00e9gislatif n\u00b0 152\/1997. Pour des informations plus d\u00e9taill\u00e9es, il peut renvoyer \u00e0 la convention collective ou aux documents de l\u2019entreprise, qui doivent \u00eatre remis au travailleur ou mis \u00e0 la disposition de ce dernier conform\u00e9ment aux pratiques en vigueur dans l\u2019entreprise.<\/p>\n\n\n\n<p>Selon le Minist\u00e8re, l\u2019objectif de cette r\u00e9forme est d\u2019\u00e9largir et de renforcer les obligations d\u2019information, mais cette op\u00e9ration d\u2019\u00e9largissement et de renforcement doit s\u2019adapter au caract\u00e8re concret de la relation de travail, en ce sens que l\u2019obligation d\u2019information ne peut \u00ab <em>\u00eatre consid\u00e9r\u00e9e comme remplie par un rappel abstrait aux dispositions l\u00e9gales qui r\u00e8glent les \u00e9l\u00e9ments du contrat objet de l\u2019information, mais seulement au travers de la communication de comment ces \u00e9l\u00e9ments s\u2019appliquent concr\u00e8tement, dans les limites consenties par la loi, dans les rapports entre les parties, m\u00eame au moyen d\u2019un rappel \u00e0 la n\u00e9gociation collective applicable au contrat de travail \u00bb.<\/em><\/p>\n\n\n\n<p>Dans le cadre des nouvelles obligations d\u2019information impos\u00e9es \u00e0 l\u2019employeur, la circulaire pr\u00e9cise certains aspects sp\u00e9cifiques, comme de ci-dessous.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Cong\u00e9s<\/strong><\/h2>\n\n\n\n<p>En ce qui concerne les informations \u00e0 fournir concernant la \u00ab <em>dur\u00e9e des cong\u00e9s pour vacances, ainsi que celle des autres cong\u00e9s r\u00e9tribu\u00e9s auxquels le travailleur a droit ou, si cela ne peut \u00eatre indiqu\u00e9 au moment de l\u2019information, les modalit\u00e9s de d\u00e9termination et de jouissance de ceux-ci \u00bb<\/em>, le Minist\u00e8re a pr\u00e9cis\u00e9 que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l\u2019employeur a l\u2019obligation d\u2019indiquer la \u00ab dur\u00e9e \u00bb des cong\u00e9s pour vacances ;<\/li>\n\n\n\n<li>en ce qui concerne la notion de \u00ab cong\u00e9s \u00bb, on tient compte exclusivement des \u00ab cong\u00e9s pay\u00e9s \u00bb. Il n\u2019est donc pas obligatoire de communiquer les cong\u00e9s pour lesquels le versement de la r\u00e9tribution n\u2019est pas pr\u00e9vu ;<\/li>\n\n\n\n<li>l\u2019obligation d\u2019information porte seulement sur les abstentions express\u00e9ment qualifi\u00e9es par le l\u00e9gislateur comme \u00ab cong\u00e9s \u00bb. Ainsi, \u00e0 titre d\u2019exemple et non limitatif : (i) le cong\u00e9 de maternit\u00e9 et de paternit\u00e9 ; (ii) le cong\u00e9 parental ; (iii) le cong\u00e9 extraordinaire pour assistance aux proches en situation de handicap ; (iv) le cong\u00e9 pour assistance aux proches en perte d\u2019autonomie ; (v) le cong\u00e9 pour les femmes victimes de violence de genre.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>R\u00e9tribution<\/strong><\/h2>\n\n\n\n<p>Concernant l\u2019obligation d\u2019informer le travailleur sur \u00ab <em>le montant initial de la r\u00e9tribution ou de fa\u00e7on g\u00e9n\u00e9rale la r\u00e9mun\u00e9ration et les \u00e9l\u00e9ments qui la constituent, avec l\u2019indication de la p\u00e9riode et des modalit\u00e9s de paiement \u00bb<\/em>, le Minist\u00e8re a pr\u00e9cis\u00e9 que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>avec cette formule, on se r\u00e9f\u00e8re aux composantes de la r\u00e9tribution qu\u2019il serait \u00ab <em>objectivement possible de d\u00e9terminer au moment de l\u2019embauche \u00bb <\/em>;<\/li>\n\n\n\n<li>l\u2019employeur \u00ab <em>ne pourra pas indiquer le montant des \u00e9l\u00e9ments variables de la r\u00e9tribution \u00bb<\/em>, mais il est tenu d\u2019indiquer au travailleur sur la base de quels \u00ab crit\u00e8res \u00bb ces \u00e9l\u00e9ments variables seront calcul\u00e9s et vers\u00e9s ;<\/li>\n\n\n\n<li>les prestations sociales offertes par l\u2019entreprise ou les tickets repas ne font pas partie habituellement de la r\u00e9tribution et ne sont donc pas concern\u00e9s par l\u2019information, \u00e0 moins qu\u2019ils ne soient pr\u00e9vus par la n\u00e9gociation collective ou par les pratiques de l\u2019entreprise comme des composantes de la r\u00e9tribution.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Horaire de travail programm\u00e9<\/strong><\/h2>\n\n\n\n<p>L\u2019employeur doit informer sur \u00ab <em>la programmation de l\u2019horaire normal de travail et les \u00e9ventuelles conditions relatives aux heures suppl\u00e9mentaires et \u00e0 leur r\u00e9tribution, ainsi que sur les \u00e9ventuelles conditions pour le changement des heures de travail, si le contrat de travail pr\u00e9voit une organisation de l\u2019horaire de travail en tout ou en grande partie pr\u00e9visible <\/em>\u00bb ;<\/p>\n\n\n\n<p>\u00c0 cet \u00e9gard, le Minist\u00e8re du Travail pr\u00e9cise que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les informations doivent porter \u00ab <em>plus que sur la l\u00e9gislation en g\u00e9n\u00e9ral, surtout sur les r\u00e9f\u00e9rences \u00e0 la convention collective nationale et aux \u00e9ventuels accords d\u2019entreprise <\/em>\u00bb qui la r\u00e9glementent ;<\/li>\n\n\n\n<li>les informations doivent \u00eatre centr\u00e9es sur \u00ab <em>l\u2019organisation concr\u00e8te de l\u2019horaire de travail <\/em>\u00bb appliqu\u00e9e au salari\u00e9, \u00ab <em>sur les modalit\u00e9s et les limites des heures suppl\u00e9mentaires et sur leur r\u00e9tribution <\/em>\u00bb.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Obligations d\u2019information suppl\u00e9mentaires en cas d\u2019utilisation de syst\u00e8mes de d\u00e9cision ou de contr\u00f4le automatis\u00e9s<\/strong><\/h2>\n\n\n\n<p>Comme on le sait, l\u2019article 1-bis du d\u00e9cret l\u00e9gislatif n\u00b0 152\/1997, ins\u00e9r\u00e9 par l\u2019article 4, lettre b), du d\u00e9cret Transparence, pr\u00e9voit \u00e0 la charge de l\u2019employeur des obligations d\u2019information suppl\u00e9mentaires au cas o\u00f9 il utiliserait des syst\u00e8mes de d\u00e9cision ou de contr\u00f4le automatis\u00e9s.<\/p>\n\n\n\n<p>Avec la circulaire en objet, le Minist\u00e8re du Travail a pr\u00e9cis\u00e9 que la lecture du texte permet d\u2019envisager deux hypoth\u00e8ses distinctes que le d\u00e9cret a voulu r\u00e9glementer concernant les obligations d\u2019information, au cas o\u00f9 l\u2019employeur utiliserait des syst\u00e8mes de d\u00e9cision ou de contr\u00f4le automatis\u00e9s :<\/p>\n\n\n\n<ol style=\"list-style-type:lower-alpha\" class=\"wp-block-list\">\n<li>qui seraient finalis\u00e9s \u00e0 mettre en place un processus de d\u00e9cision en mesure d\u2019influer sur la relation de travail ;<\/li>\n\n\n\n<li>qui influeraient sur la surveillance, sur l\u2019\u00e9valuation, sur les prestations et sur le respect des obligations contractuelles des travailleurs.<\/li>\n<\/ol>\n\n\n\n<p>Concernant l\u2019hypoth\u00e8se a), la circulaire donne quelques exemples pour lesquels s\u2019appliquent les obligations d\u2019information vis\u00e9es \u00e0 l\u2019art. 1 <em>bis<\/em>, \u00e0 savoir :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>l\u2019embauche ou l\u2019attribution de la mission au travers de l\u2019utilisation de <em>chatbots<\/em> pendant l\u2019entretien, le profilage automatis\u00e9 des candidats, le screening des CV, l\u2019utilisation de logiciels pour la reconnaissance des \u00e9motions et de tests psychologiques, etc. ;<\/li>\n\n\n\n<li>la gestion ou la cessation de la relation de travail avec l\u2019attribution ou la r\u00e9vocation automatis\u00e9e de fonctions, de missions ou d\u2019horaires, la d\u00e9termination de l\u2019horaire de travail, l\u2019analyse de la productivit\u00e9, la d\u00e9termination de la r\u00e9tribution, les promotions, etc., au travers d\u2019analyses statistiques, d\u2019instruments d\u2019analyse de donn\u00e9es ou d\u2019apprentissage automatique, r\u00e9seaux neuronaux, deep-learning, etc.<\/li>\n<\/ul>\n\n\n\n<p>En revanche, l\u2019hypoth\u00e8seb) concernant \u00ab <em>les indications influant sur la surveillance, l\u2019\u00e9valuation, les prestations et l\u2019ex\u00e9cution des obligations contractuelles des travailleurs \u00bb<\/em> m\u00e9rite un discours \u00e0 part. M\u00eame dans cette hypoth\u00e8se, selon le Minist\u00e8re, l\u2019employeur a l\u2019obligation d\u2019informer le travailleur de l\u2019utilisation de ces syst\u00e8mes automatis\u00e9s, comme \u2013 \u00e0 simple titre d\u2019exemple : tablettes, dispositifs digitaux et portables, GPS et g\u00e9o-localisateurs, syst\u00e8mes de reconnaissance faciale, syst\u00e8mes de classement et d\u2019\u00e9valuation, etc.<\/p>\n\n\n\n<p><strong>Contenus corr\u00e9l\u00e9s :&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a
