{"id":28480,"date":"2022-10-31T09:00:08","date_gmt":"2022-10-31T08:00:08","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/angolo-del-contenzioso-3\/"},"modified":"2026-04-02T14:58:39","modified_gmt":"2026-04-02T12:58:39","slug":"angolo-del-contenzioso","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/angolo-del-contenzioso\/","title":{"rendered":"Les effets de la nullit\u00e9 du terme pr\u00e9vu au contrat en cas de transfert d\u2019entreprise"},"content":{"rendered":"\n<p>La Cour de Cassation, par son ordonnance n\u00b0 21453 du 6 juillet 2022, a statu\u00e9 que, dans le cadre d\u2019un transfert d\u2019entreprise, le travailleur r\u00e9int\u00e9gr\u00e9 suite \u00e0 la d\u00e9claration de nullit\u00e9 du terme pr\u00e9vu au contrat de travail doit \u00eatre consid\u00e9r\u00e9 comme transf\u00e9r\u00e9 <em>ex lege<\/em> au service direct du cessionnaire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Faits<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Le cas d\u2019esp\u00e8ce \u00e0 l\u2019origine de l\u2019ordonnance examin\u00e9e concerne l\u2019efficacit\u00e9 d\u2019un transfert d\u2019entreprise \u00e0 l\u2019encontre d\u2019un travailleur embauch\u00e9 avec un contrat \u00e0 terme par le c\u00e9dant et r\u00e9int\u00e9gr\u00e9 dans la soci\u00e9t\u00e9 cessionnaire apr\u00e8s ce transfert.<\/p>\n\n\n\n<p>Le Tribunal et la Cour d\u2019appel de Milan ont tous deux estim\u00e9 que &#8211; puisque la sentence d\u00e9clarant la nullit\u00e9 du terme pr\u00e9vu au contrat de travail r\u00e9tablit le contrat &#8211; le travailleur devait \u00eatre consid\u00e9r\u00e9 comme partie int\u00e9grante de l\u2019entreprise au moment de la cession et, donc, comme automatiquement transf\u00e9r\u00e9 au service direct du cessionnaire.<\/p>\n\n\n\n<p>Les juges du fond ont, en effet, affirm\u00e9 que, m\u00eame si au moment du transfert d\u2019entreprise la relation de travail n\u2019\u00e9tait pas, de fait, en vigueur \u00e0 cause de l\u2019\u00e9ch\u00e9ance du terme pr\u00e9vu au contrat, le contrat de travail \u2013 converti en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e suite \u00e0 la sentence d\u00e9clarant la nullit\u00e9 du terme \u2013 devait, dans tous les cas, \u00eatre consid\u00e9r\u00e9 comme existant \u00ab <em>en droit, m\u00eame s\u2019il ne l\u2019\u00e9tait pas de fait \u00bb<\/em>.<\/p>\n\n\n\n<p>La soci\u00e9t\u00e9 employeur a d\u00e9pos\u00e9 un pourvoi contre la d\u00e9cision de la Cour d\u2019appel de Milan.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>L\u2019ordonnance de la Cour de cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de cassation a rejet\u00e9 le pourvoi d\u00e9pos\u00e9 par la soci\u00e9t\u00e9 cessionnaire et statu\u00e9 que, en mati\u00e8re de contrats de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e, la sentence d\u00e9clarant la nullit\u00e9 de la clause stipulant le terme et ordonnant le r\u00e9tablissement de la relation ill\u00e9galement interrompue a une nature d\u00e9claratoire et non constitutive.<\/p>\n\n\n\n<p>En cons\u00e9quence, la conversion en une relation de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e agit \u00ab <em>ex tunc \u00bb<\/em>, c\u2019est-\u00e0-dire \u00e0 compter de la stipulation ill\u00e9gale du contrat \u00e0 terme.<\/p>\n\n\n\n<p>\u00c0 partir du moment o\u00f9 l\u2019inefficacit\u00e9 du terme pr\u00e9vu au contrat de travail du salari\u00e9 est d\u00e9clar\u00e9e, la relation de travail doit donc \u00eatre consid\u00e9r\u00e9e comme \u00e9tant \u00e0 dur\u00e9e ind\u00e9termin\u00e9e d\u00e8s son origine, d\u2019o\u00f9 la poursuite automatique de la relation de travail au service du cessionnaire, conform\u00e9ment \u00e0 l\u2019art. 2112 du Code civil italien.<\/p>\n\n\n\n<p><strong>Contenus corr\u00e9l\u00e9s :&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/la-cour-de-cassation-se-prononce-sur-la-notion-de-transfert-de-branche-dentreprise\/\">La Cour de Cassation se prononce sur la notion de transfert de branche d\u2019entreprise<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/transfert-dentreprise-et-retrogradation\/\">Transfert d\u2019entreprise et r\u00e9trogradation<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/transfert-illegitime-dentreprise-et-double-remuneration\/\">Transfert ill\u00e9gitime d\u2019entreprise et \u00ab double r\u00e9mun\u00e9ration \u00bb<\/a><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de Cassation, par son ordonnance n\u00b0 21453 du 6 juillet 2022, a statu\u00e9 que, dans le cadre d\u2019un transfert d\u2019entreprise, le travailleur r\u00e9int\u00e9gr\u00e9 suite \u00e0 la d\u00e9claration de nullit\u00e9 du terme pr\u00e9vu au contrat de travail doit \u00eatre consid\u00e9r\u00e9 comme transf\u00e9r\u00e9 ex lege au service direct du cessionnaire.
