{"id":28507,"date":"2024-01-12T15:26:58","date_gmt":"2024-01-12T14:26:58","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/licenziamento-della-lavoratrice-madre-in-caso-di-cessazione-dellattivita-dimpresa-camera-di-commercio-di-spagna-in-italia-enrico-de-luca-luca-cairoli-3\/"},"modified":"2026-02-16T16:35:38","modified_gmt":"2026-02-16T15:35:38","slug":"licenziamento-della-lavoratrice-madre-in-caso-di-cessazione-dellattivita-dimpresa-camera-di-commercio-di-spagna-in-italia-enrico-de-luca-luca-cairoli","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/licenciement-de-la-mere-travailleuse-en-cas-de-cessation-de-lactivite-de-lentreprise\/","title":{"rendered":"Licenciement de la m\u00e8re travailleuse en cas de cessation de l&rsquo;activit\u00e9 de l&rsquo;entreprise (Chambre de commerce espagnole en Italie &#8211; Enrico De Luca, Luca Cairoli)"},"content":{"rendered":"\n<p>\u00c0 travers l\u2019ordonnance n\u00b0 35527 du 19 d\u00e9cembre 2023, la Cour de cassation italienne s&rsquo;est prononc\u00e9e sur le licenciement d&rsquo;une m\u00e8re salari\u00e9e prononc\u00e9 en raison de la cessation d&rsquo;activit\u00e9 de l&#8217;employeur suite \u00e0 la d\u00e9claration de faillite, en le d\u00e9clarant nul et non avenu et en condamnant l&#8217;employeur \u00e0 r\u00e9int\u00e9grer la salari\u00e9e et \u00e0 lui verser une indemnit\u00e9 p\u00e9cuniaire.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le cadre factuel<\/strong><\/h2>\n\n\n\n<p>En l&rsquo;esp\u00e8ce, la salari\u00e9e a \u00e9t\u00e9 licenci\u00e9e par l\u2019administrateur judiciaire &#8211; peu apr\u00e8s son retour du cong\u00e9 de maternit\u00e9 obligatoire et avant que son enfant n&rsquo;atteigne l&rsquo;\u00e2ge d&rsquo;un an &#8211; parce que la Coop\u00e9rative, son employeur, avait \u00e9t\u00e9 d\u00e9clar\u00e9e en faillite.<\/p>\n\n\n\n<p>L&#8217;employ\u00e9e a contest\u00e9 le licenciement devant le Tribunal d&rsquo;Arezzo, affirmant qu&rsquo;il \u00e9tait nul et non avenu parce qu&rsquo;il avait \u00e9t\u00e9 annonc\u00e9 dans l&rsquo;ann\u00e9e de la naissance de son enfant. Le Tribunal a fait droit \u00e0 la demande de la salari\u00e9e, a d\u00e9clar\u00e9 le licenciement nul et a ordonn\u00e9 \u00e0 l\u2019administrateur judiciaire de r\u00e9int\u00e9grer la salari\u00e9e, outre le paiement d&rsquo;une indemnit\u00e9 proportionn\u00e9e \u00e0 son dernier salaire.<\/p>\n\n\n\n<p>La Cour d&rsquo;appel de Florence, \u00e0 la suite de la proc\u00e9dure engag\u00e9e par l\u2019administrateur judiciaire a confirm\u00e9 le jugement de premi\u00e8re instance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>L&rsquo;arr\u00eat de la Cour de cassation<\/strong><\/h2>\n\n\n\n<p>La Cour de cassation italienne, saisie de l&rsquo;affaire, a examin\u00e9 la notion de \u00ab&nbsp;<em>cessation de l\u2019activit\u00e9 d\u2019entreprise<\/em>&nbsp;\u00bb figurant \u00e0 l&rsquo;article 54, troisi\u00e8me alin\u00e9a, lettre b), du D\u00e9cret l\u00e9gislatif italien 151\/2001 comme l&rsquo;un des cas de d\u00e9rogation \u00e0 l&rsquo;interdiction g\u00e9n\u00e9rale de licenciement des m\u00e8res qui travaillent dans la premi\u00e8re ann\u00e9e de la naissance de l&rsquo;enfant.<\/p>\n\n\n\n<p>En particulier, la Cour a \u00e9valu\u00e9 l&rsquo;hypoth\u00e8se dans laquelle l&rsquo;exercice provisoire de l&rsquo;activit\u00e9 commerciale n&rsquo;a pas \u00e9t\u00e9 ordonn\u00e9 par le jugement d\u00e9claratif de faillite, ni autoris\u00e9 ult\u00e9rieurement par le juge d\u00e9l\u00e9gu\u00e9, dans un contexte o\u00f9, apr\u00e8s la faillite, \u00ab&nbsp;<em>il avait<\/em><em> \u00e9t\u00e9 d\u00e9montr\u00e9 que les activit\u00e9s de liquidation n&rsquo;avaient pas commenc\u00e9 et que, au contraire, des activit\u00e9s conservatoires \u00e9taient en cours en vue d&rsquo;un transfert \u00e0 des tiers (raison pour laquelle une s\u00e9lection du personnel \u00e0 maintenir en service \u00e9tait en cours)<\/em>&nbsp;\u00bb.<\/p>\n\n\n\n<p>Selon la Cour, l\u2019examen de la l\u00e9gislation sur les faillites et de celle contenue dans l&rsquo;article 54 fait ressortir que le jugement d\u00e9claratif de faillite implique la cessation formelle de l&rsquo;activit\u00e9 d\u2019entreprise (\u00e0 l&rsquo;exception de l&rsquo;exercice provisoire autoris\u00e9), alors que le concept de cessation qui sous-tend l&rsquo;article 54 a une port\u00e9e diff\u00e9rente.<\/p>\n\n\n\n<p>Selon la Cour, l&rsquo;exception \u00e0 l&rsquo;interdiction de licenciement dict\u00e9e par la \u00ab&nbsp;<em>cessation de l\u2019activit\u00e9<\/em>&nbsp;\u00bb ne joue que dans les cas o\u00f9 toute possibilit\u00e9 de continuation ou de persistance de l&rsquo;entreprise, pour quelque raison que ce soit, est exclue, et ce en raison de la protection pr\u00e9\u00e9minente des droits de la m\u00e8re travailleuse \u00e0 l&rsquo;\u00e9gard des droits patrimoniaux, qui sont sauvegard\u00e9s par la <em>par <\/em><em>condicio creditorum<\/em> (au stade de le faillite).<\/p>\n\n\n\n<p>Rappelant ses pr\u00e9c\u00e9dentes d\u00e9cisions en la mati\u00e8re, la Cour, dans l&rsquo;arr\u00eat comment\u00e9, pr\u00e9cise que l&rsquo;exception pr\u00e9vue \u00e0 l&rsquo;article 54 doit \u00eatre contenue dans des <em>\u00ab&nbsp;limites pr\u00e9cises et circonscrites&nbsp;\u00bb <\/em>et que <em>\u00ab&nbsp;compte tenu du fait que l&rsquo;extinction de la relation est un \u00e9v\u00e9nement extraordinaire ou n\u00e9cessaire&nbsp;\u00bb, <\/em>elle ne peut \u00eatre interpr\u00e9t\u00e9e de mani\u00e8re extensive (Cassation. N\u00b0 13861\/2021).
