prescrite par l&rsquo;article 7 de la Loi italienne n\u00b0 604\/1966 en cas de licenciement pour des raisons objectives justifi\u00e9es de travailleurs embauch\u00e9s avant mars 2015 &#8211; l&#8217;employeur n&rsquo;est pas tenu d&rsquo;envoyer au salari\u00e9 une lettre de licenciement, l&rsquo;indication de l&rsquo;intention de mettre fin \u00e0 la relation contenue dans le rapport \u00e9tabli aupr\u00e8s de l&rsquo;Inspection territoriale du travail italienne (<em>Ispettorato Territoriale del Lavoro<\/em>) \u00e9tant suffisante.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le cas d\u2019esp\u00e8ce<\/strong><\/h2>\n\n\n\n<p>\u00c0 l&rsquo;issue de la tentative de conciliation men\u00e9e devant l&rsquo;ITL conform\u00e9ment \u00e0 l&rsquo;article 7 de la Loi italienne n\u00b0 604\/1966, un proc\u00e8s-verbal de non-conciliation a \u00e9t\u00e9 \u00e9tabli, dans lequel l&rsquo;intention de l&#8217;employeur de licencier le travailleur pour des raisons objectives a \u00e9t\u00e9 formalis\u00e9e.<\/p>\n\n\n\n<p>Par la suite, la salari\u00e9e a contest\u00e9 son licenciement en justice, arguant tout d&rsquo;abord de son inefficacit\u00e9 en raison de l&rsquo;absence de forme \u00e9crite.<\/p>\n\n\n\n<p>Dans le cadre de la phase en r\u00e9f\u00e9r\u00e9 de l&rsquo;initiative du \u00ab&nbsp;<em>Rito Fornero<\/em>&nbsp;\u00bb (proc\u00e9dure acc\u00e9l\u00e9r\u00e9e pour les litiges en mati\u00e8re de licenciement) ainsi que dans la phase d&rsquo;opposition qui a suivi, le juge a constat\u00e9 l&rsquo;absence de forme \u00e9crite du licenciement et a par cons\u00e9quent ordonn\u00e9 \u00e0 l&#8217;employeur de r\u00e9int\u00e9grer la salari\u00e9e.<\/p>\n\n\n\n<p>La Cour d&rsquo;appel italienne &#8211; saisie par l&#8217;employeur &#8211; a r\u00e9form\u00e9 le jugement rendu au stade de l\u2019opposition.<\/p>\n\n\n\n<p>La Cour territoriale a estim\u00e9, d&rsquo;une part, que la forme \u00e9crite de la r\u00e9siliation \u00e9tait prouv\u00e9e &#8211; et ce parce que l&rsquo;intention de mettre fin \u00e0 la relation de travail \u00e9tait contenue dans le proc\u00e8s-verbal sign\u00e9 par les deux parties \u00e0 l&rsquo;issue de la proc\u00e9dure pr\u00e9vue par l\u2019article 7 de la Loi italienne n\u00b0 604\/1966 &nbsp;&#8211; et, d&rsquo;autre part, consid\u00e9rant que le principe d&rsquo;\u00e9quit\u00e9 et de bonne foi avait \u00e9t\u00e9 viol\u00e9 en ce qui concerne le choix de la salari\u00e9e \u00e0 licencier, a d\u00e9clar\u00e9 le licenciement ill\u00e9gal et a condamn\u00e9 l&#8217;employeur aux frais qui en d\u00e9coulent en vertu de l&rsquo;art. 18, alin\u00e9a 7, du Code du travail italien (<em>Statuto dei Lavoratori<\/em>).<\/p>\n\n\n\n<p>La salari\u00e9e a fait appel de l\u2019arr\u00eat devant la Cour de cassation italienne et la soci\u00e9t\u00e9, en s&rsquo;opposant par le d\u00e9p\u00f4t d&rsquo;un m\u00e9moire en d\u00e9fense, a form\u00e9 \u00e0 son tour un recours incident.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le recours devant la Cour de cassation italienne et sa d\u00e9cision<\/strong><\/h2>\n\n\n\n<p>La Cour de cassation italienne &#8211; en confirmant l&rsquo;arr\u00eat sur le fond \u2013 a tout d&rsquo;abord rappel\u00e9 que la finalit\u00e9 de l&rsquo;exigence d&rsquo;une forme \u00e9crite pour le licenciement r\u00e9side dans la n\u00e9cessit\u00e9 de faire conna\u00eetre au salari\u00e9 l&rsquo;acte qui interrompt la relation.<\/p>\n\n\n\n<p>Cette fonction &#8211; poursuit la Cour &#8211; est remplie si l&rsquo;intention de proc\u00e9der au licenciement a \u00e9t\u00e9 formalis\u00e9e par l&#8217;employeur, aupr\u00e8s d\u2019un si\u00e8ge institutionnel (ce qui est certainement le cas de l&rsquo;Inspection du travail italienne o\u00f9 une conciliation a \u00e9t\u00e9 tent\u00e9e en vertu de l&rsquo;article 7 de la Loi italienne n\u00b0 604\/1966), dans un proc\u00e8s-verbal sign\u00e9 \u00e9galement par l&#8217;employ\u00e9.<\/p>\n\n\n\n<p>La disposition normative de la troisi\u00e8me phrase de l\u2019alin\u00e9a 6 de l&rsquo;article 7 de la loi italienne n\u00b0 604\/1966 (<em>\u00ab&nbsp;Si la tentative de conciliation \u00e9choue et, en tout \u00e9tat de cause, si le d\u00e9lai vis\u00e9 \u00e0 l\u2019alin\u00e9a 3 est \u00e9coul\u00e9, l&#8217;employeur peut communiquer le licenciement au travailleur<\/em>&nbsp;\u00bb) \u00e9tablit une condition l\u00e9gale (suspensive) et un d\u00e9lai (de prorogation). Par cons\u00e9quent, une fois que la premi\u00e8re est remplie ou que le d\u00e9lai est \u00e9coul\u00e9, l&#8217;employeur \u00ab&nbsp;peut communiquer le licenciement au travailleur&nbsp;\u00bb.<\/p>\n\n\n\n<p>En ce qui concerne le sens \u00e0 attribuer \u00e0 la condition juridique suspensive (\u00e0 savoir \u00e0 l&rsquo;\u00e9chec de la tentative de conciliation), pour la Cour de cassation italienne \u00ab&nbsp;<em>les donn\u00e9es litt\u00e9rales&nbsp;elles-m\u00eames<\/em> \u00bb sugg\u00e8rent que le l\u00e9gislateur <em>\u00ab&nbsp;a attribu\u00e9 de l&rsquo;importance au fait objectif de l&rsquo;\u00e9chec de la tentative de conciliation plut\u00f4t qu&rsquo;au fait chronologique et formel de la cl\u00f4ture du proc\u00e8s-verbal \u00e9tabli au stade de la commission provinciale de conciliation<\/em>&nbsp;\u00bb.<\/p>\n\n\n\n<p>En outre, poursuit la Cour, <em>\u00ab&nbsp;le libell\u00e9 de la disposition n&rsquo;exige pas que la notification du licenciement, qui est permise \u00e0 l&#8217;employeur \u00ab\u00a0en cas d&rsquo;\u00e9chec de la tentative de conciliation\u00a0\u00bb, intervienne dans un contexte diff\u00e9rent et post\u00e9rieur \u00e0 celui du proc\u00e8s-verbal pr\u00e9cit\u00e9<\/em>&nbsp;\u00bb.<\/p>\n\n\n\n<p>En ce sens, affirme le Coll\u00e8ge, <em>\u00ab&nbsp;aucune n\u00e9cessit\u00e9 de prot\u00e9ger les int\u00e9r\u00eats du travailleur ne pourrait plausiblement justifier l&rsquo;hypoth\u00e8se selon laquelle la communication du licenciement au travailleur doit n\u00e9cessairement avoir lieu dans un contexte distinct du proc\u00e8s-verbal \u00e9tabli lors de la r\u00e9union devant la commission sp\u00e9ciale, \u00e0 condition, bien entendu, que pour la communication du licenciement d\u00e9j\u00e0 exprim\u00e9e lors de cette r\u00e9union, les autres exigences en mati\u00e8re de licenciement soient respect\u00e9es, \u00e0 commencer par celle de la forme \u00e9crite en vertu de l&rsquo;article 2, alin\u00e9a 1, de la Loi [italienne] n\u00b0 604\/1966&nbsp;\u00bb.<\/em><\/p>\n\n\n\n<p>Selon les juges de la Cour de cassation italienne, il s&rsquo;ensuit que lorsque la tentative de conciliation pr\u00e9vue \u00e0 l&rsquo;article 7 de la Loi italienne n\u00b0 604\/1966 \u00e9choue et que l&#8217;employeur confirme sa volont\u00e9 de mettre fin \u00e0 la relation, il n&rsquo;est pas n\u00e9cessaire d&rsquo;envoyer ensuite \u00e0 l&#8217;employ\u00e9 une lettre de licenciement.<\/p>\n\n\n\n<p>Pour ces raisons, la Cour de cassation italienne a donc rejet\u00e9 le
