ordonnance n\u00b0 6782 du 14 mars 2024, la Cour de cassation italienne a affirm\u00e9 le principe de droit suivant : <em>\u00ab&nbsp;dans le cadre d&rsquo;une relation de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, la dispense de pr\u00e9avis par l&#8217;employeur, face \u00e0 la d\u00e9mission du salari\u00e9, n&rsquo;ouvre pas droit \u00e0 ce dernier de percevoir l&rsquo;indemnit\u00e9 qui en tient lieu, compte tenu du caract\u00e8re obligatoire du pr\u00e9avis&nbsp;\u00bb<\/em>.<\/p>\n\n\n\n<p>Une salari\u00e9e a pr\u00e9sent\u00e9 sa d\u00e9mission et, en cons\u00e9quence, l&#8217;employeur a d\u00e9cid\u00e9 de la dispenser d&rsquo;ex\u00e9cuter son pr\u00e9avis, sans lui verser l&rsquo;indemnit\u00e9 compensatoire correspondante.<\/p>\n\n\n\n<p>La salari\u00e9e d\u00e9missionnaire a intent\u00e9 une action en justice pour obtenir l&rsquo;octroi de l&rsquo;indemnit\u00e9 compensatoire de pr\u00e9avis.<\/p>\n\n\n\n<p>Le tribunal de Pise a fait droit au recours de la salari\u00e9e et, en appel, le jugement a \u00e9galement \u00e9t\u00e9 confirm\u00e9 par la cour d&rsquo;appel de Florence.<\/p>\n\n\n\n<p>Les deux juridictions de fond, ont fond\u00e9 leur d\u00e9cision sur l&rsquo;hypoth\u00e8se que l&#8217;employeur, bien qu&rsquo;ayant lib\u00e9r\u00e9 la partie demanderesse du travail pour la dur\u00e9e du pr\u00e9avis, \u00e9tait n\u00e9anmoins tenu de lui verser l&rsquo;\u00e9quivalent du montant de la r\u00e9mun\u00e9ration \u00e0 laquelle elle aurait eu droit pour la p\u00e9riode de pr\u00e9avis.<\/p>\n\n\n\n<p>La soci\u00e9t\u00e9 s\u2019est oppos\u00e9e \u00e0 l\u2019arr\u00eat de la Cour d\u2019appel italienne en pr\u00e9sentant un recours devant la Cour de cassation italienne.<\/p>\n\n\n\n<p>Les juges de la Cour de cassation italienne, infirmant le jugement sur le fond, ont jug\u00e9 que dans le cadre d&rsquo;une relation de travail \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, la renonciation de l&#8217;employeur au pr\u00e9avis en cas de d\u00e9mission du salari\u00e9 <em>\u00ab&nbsp;ne conf\u00e8re pas le droit \u00e0 ce dernier de percevoir l&rsquo;indemnit\u00e9 qui en tient lieu, compte tenu du caract\u00e8re imp\u00e9ratif du pr\u00e9avis<\/em>&nbsp;\u00bb.<\/p>\n\n\n\n<p>Les juges soulignent donc que le pr\u00e9avis est obligatoire et que, par cons\u00e9quent, si l&rsquo;une des parties exerce l&rsquo;option de r\u00e9siliation avec effet imm\u00e9diat, la relation est \u00e9galement r\u00e9sili\u00e9e imm\u00e9diatement, la seule obligation de la partie r\u00e9siliante \u00e9tant de payer l&rsquo;indemnit\u00e9 qui en tient lieu.<\/p>\n\n\n\n<p>Selon les juges de la Cour de cassation italienne, en revanche, la partie non r\u00e9siliante peut librement renoncer \u00e0 son pr\u00e9avis sans rien reconna\u00eetre \u00e0 l&rsquo;autre partie, qui ne peut revendiquer aucun droit \u00e0 la poursuite de la relation de travail jusqu&rsquo;\u00e0 la fin de la p\u00e9riode de pr\u00e9avis.<\/p>\n\n\n\n<p>Pour ces raisons, la Cour de cassation italienne a fait droit au pourvoi form\u00e9 par la soci\u00e9t\u00e9, estimant que l&rsquo;indemnit\u00e9 de pr\u00e9avis
