La Cour a soulign\u00e9 que la communication de la maladie pouvait \u00e9galement se faire sous des formes autres que la lettre recommand\u00e9e, si cela est pr\u00e9vu par le r\u00e8glement interne.<\/p>\n\n\n\n<p><strong>Contrat de travail \u2013 Communication de la maladie \u2013 modalit\u00e9s de transmission \u2013 certificat m\u00e9dical \u2013 fax comme moyen valable \u2013 r\u00e8glement interne \u2013 r\u00e9ception pr\u00e9sum\u00e9e \u2013 preuve de la transmission \u2013 comportement du salari\u00e9 \u2013 maladie \u00e0 l\u2019\u00e9tranger \u2013 licenciement pour juste cause \u2013 transmission effective<\/strong><\/p>\n\n\n\n<p>La communication de la maladie au employeur peut valablement s\u2019effectuer par fax, lorsque ce mode est express\u00e9ment pr\u00e9vu par le r\u00e8glement interne. Dans ce cas, il est pr\u00e9sum\u00e9 que le fax a \u00e9t\u00e9 correctement re\u00e7u par l\u2019employeur si le salari\u00e9 peut justifier, par les rapports de transmission, du bon aboutissement de la communication, m\u00eame en l\u2019absence de traces sur les serveurs de l\u2019entreprise. Le comportement du salari\u00e9 concernant la communication de la maladie \u00e0 l\u2019\u00e9tranger, m\u00eame s\u2019il peut \u00eatre consid\u00e9r\u00e9 comme peu diligent, ne suffit pas \u00e0 constituer une juste cause de licenciement, sauf preuve que le salari\u00e9 \u00e9tait conscient de l\u2019\u00e9chec de la transmission.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits de l\u2019affaire<\/strong><\/h2>\n\n\n\n<p>Le cas examin\u00e9 par la Cour de cassation concerne un licenciement pour juste cause pour \u00ab absence injustifi\u00e9e de plus de quatre jours \u00bb inflig\u00e9 \u00e0 un salari\u00e9 qui, en cong\u00e9 en Roumanie, \u00e9tait tomb\u00e9 malade. Le salari\u00e9 a soutenu le caract\u00e8re justifi\u00e9 de son absence, affirmant avoir contract\u00e9 la maladie durant ses cong\u00e9s et, par cons\u00e9quent, avoir envoy\u00e9 le certificat m\u00e9dical par fax, conform\u00e9ment au r\u00e8glement interne de l\u2019entreprise.<\/p>\n\n\n\n<p>Suite au licenciement, le salari\u00e9 a contest\u00e9 la mesure devant le Tribunal de Tr\u00e9vise, demandant l\u2019annulation du licenciement pour inexistence des faits reproch\u00e9s.<\/p>\n\n\n\n<p>L\u2019argument principal de la d\u00e9fense de l\u2019entreprise reposait sur la pr\u00e9tendue inad\u00e9quation de la communication de la maladie. En l\u2019esp\u00e8ce, la soci\u00e9t\u00e9 soutenait que le salari\u00e9 n\u2019avait pas respect\u00e9 les proc\u00e9dures pr\u00e9vues par le r\u00e8glement interne, qui, selon elle, exigeaient une communication plus \u00ab formelle \u00bb, g\u00e9n\u00e9ralement par lettre recommand\u00e9e, ainsi qu\u2019un pr\u00e9avis t\u00e9l\u00e9phonique. Le salari\u00e9, pour sa part, r\u00e9pliquait que l\u2019envoi par fax \u00e9tait un mode autoris\u00e9 par le r\u00e8glement et que le certificat avait \u00e9t\u00e9 correctement transmis, comme le d\u00e9montrait le rapport de transmission.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2024\/10\/dimissioni-shutterstock_1182037858-1024x683.jpg\" alt=\"\" class=\"wp-image-19178\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"U32800524883TEY\"><strong>Les diff\u00e9rents degr\u00e9s de juridiction<\/strong><\/h2>\n\n\n\n<p>Lors de la phase sommaire, le Tribunal de Tr\u00e9vise a accueilli la contestation du salari\u00e9, annulant le licenciement et ordonnant sa r\u00e9int\u00e9gration. De plus, il a condamn\u00e9 la soci\u00e9t\u00e9 au paiement \u00ab d\u2019une indemnit\u00e9 compensatoire calcul\u00e9e sur la derni\u00e8re r\u00e9mun\u00e9ration globale de fait depuis le jour du licenciement jusqu\u2019\u00e0 la r\u00e9int\u00e9gration effective \u00bb.<\/p>\n\n\n\n<p>Contre la d\u00e9cision du Tribunal, l\u2019entreprise a ensuite d\u00e9pos\u00e9 son recours devant la Cour d\u2019Appel de Venise, qui a partiellement accueilli l\u2019appel, confirmant l\u2019ill\u00e9galit\u00e9 du licenciement et la r\u00e9int\u00e9gration, mais r\u00e9duisant l\u2019indemnit\u00e9 compensatoire \u00e0 douze mois de salaire.<\/p>\n\n\n\n<p>La Cour a en effet soutenu que l\u2019article 40 de la convention collective appliqu\u00e9e pr\u00e9voit que l\u2019absence injustifi\u00e9e \u00e9gale ou sup\u00e9rieure \u00e0 quatre jours constitue un motif de licenciement disciplinaire, incluant dans la d\u00e9finition d\u2019absence injustifi\u00e9e aussi la communication tardive et le retard dans l\u2019envoi du certificat m\u00e9dical.<\/p>\n\n\n\n<p>De plus, selon le r\u00e8glement int\u00e9rieur de l\u2019entreprise, il est pr\u00e9cis\u00e9ment du devoir du salari\u00e9 d\u2019avertir l\u2019employeur le jour m\u00eame de l\u2019\u00e9v\u00e9nement, en plus d\u2019envoyer le certificat m\u00e9dical.<\/p>\n\n\n\n<p>Il est \u00e9galement apparu que le salari\u00e9 n\u2019avait pas justifi\u00e9 d\u2019un quelconque emp\u00eachement qui expliquerait la non-communication ; en effet, le seul message texte envoy\u00e9 datait de plusieurs jours apr\u00e8s le d\u00e9but de l\u2019absence contest\u00e9e.<\/p>\n\n\n\n<p>Un dernier aspect significatif examin\u00e9 par la Cour d\u2019Appel concernait l\u2019absence de preuve de la part du salari\u00e9 quant \u00e0 un \u00e9ventuel emp\u00eachement de communication t\u00e9l\u00e9phonique. \u00c0 ce sujet, la Cour a observ\u00e9 que \u00ab le salari\u00e9 n\u2019a pas document\u00e9 un emp\u00eachement d\u2019une telle gravit\u00e9 qu\u2019il exclurait radicalement la possibilit\u00e9 d\u2019un s\u00e9rieux effort pr\u00e9alable de contact avec le responsable de l\u2019entreprise \u00bb. Enfin, elle a soulign\u00e9 que \u00ab le salari\u00e9 a eu une conduite formellement respectueuse des obligations contractuelles, mais s\u2019est limit\u00e9 \u00e0 les accomplir de fa\u00e7on minimale \u00bb.<\/p>\n\n\n\n<p>Par cons\u00e9quent, la Cour a relev\u00e9 que le salari\u00e9 n\u2019avait pas respect\u00e9 l\u2019obligation d\u2019avertir t\u00e9l\u00e9phoniquement l\u2019employeur, contrevenant ainsi au r\u00e8glement int\u00e9rieur et aux r\u00e8gles de diligence requises dans le cadre d\u2019un contrat de travail salari\u00e9.<\/p>\n\n\n\n<p>Contre la d\u00e9cision de la Cour d\u2019Appel, la soci\u00e9t\u00e9 a form\u00e9 un pourvoi en cassation, invoquant cinq moyens de recours.<\/p>\n\n\n\n<p>Le premier moyen se fondait sur la pr\u00e9tendue nullit\u00e9 de l\u2019arr\u00eat en raison d\u2019affirmations contradictoires et inconciliables entre elles par la Cour d\u2019Appel. En particulier, les juges de l\u2019appel auraient \u00ab d\u2019abord affirm\u00e9 que le comportement du salari\u00e9 n\u2019\u00e9tait pas lin\u00e9aire ni conforme aux r\u00e8gles \u00e9l\u00e9mentaires de diligence requises par le contrat de travail salari\u00e9 \u00bb, puis \u00ab auraient exclu l\u2019existence d\u2019une cause r\u00e9elle et s\u00e9rieuse \u00bb.<\/p>\n\n\n\n<p>La Cour de Cassation, rejetant cette th\u00e8se, a affirm\u00e9 que la contradiction n\u2019\u00e9tait qu\u2019apparente, puisque la Cour d\u2019Appel avait jug\u00e9 suffisante la modalit\u00e9 d\u2019envoi par fax, pr\u00e9vue par le r\u00e8glement int\u00e9rieur, ainsi que la preuve de sa r\u00e9ception dans le rapport de transmission produit en justice par le salari\u00e9, car un fax identique avait \u00e9t\u00e9 envoy\u00e9 \u00e0 l\u2019INPS et avait \u00e9t\u00e9 r\u00e9guli\u00e8rement re\u00e7u.<\/p>\n\n\n\n<p>Par le second moyen, la soci\u00e9t\u00e9 contestait la d\u00e9cision de la Cour pour avoir jug\u00e9 \u00ab appropri\u00e9e \u00bb la modalit\u00e9 de transmission par fax.<\/p>\n\n\n\n<p>La Cour de Cassation a consid\u00e9r\u00e9 le moyen infond\u00e9, car \u00ab le fax \u00e9tait une modalit\u00e9 pr\u00e9vue par le r\u00e8glement int\u00e9rieur \u00bb et \u00ab la norme l\u00e9gale n\u2019exclut pas des modalit\u00e9s \u00e9quivalentes selon les usages, qui peuvent \u00eatre pr\u00e9vues pr\u00e9cis\u00e9ment par un r\u00e8glement d\u2019entreprise \u00bb.<\/p>\n\n\n\n<p>Par le troisi\u00e8me moyen, la soci\u00e9t\u00e9 soutenait que la Cour territoriale avait de mani\u00e8re contradictoire \u00ab d\u2019abord affirm\u00e9 que ce n\u2019est qu\u2019en justice que l\u2019employeur avait pu v\u00e9rifier le contenu de la transmission du fax, c\u2019est-\u00e0-dire le certificat m\u00e9dical, puis avait affirm\u00e9 qu\u2019il n\u2019y avait pas de preuve de falsification ou d\u2019alt\u00e9ration du message \u00bb.<\/p>\n\n\n\n<p>L\u00e0 encore, la Cassation a rejet\u00e9 les arguments de l\u2019entreprise, affirmant que le fax devait \u00eatre consid\u00e9r\u00e9 comme un moyen de communication valable, tel que pr\u00e9vu par le r\u00e8glement int\u00e9rieur, de sorte que \u00ab la connaissance du destinataire est sans incidence au regard du fait objet de la contestation disciplinaire \u00bb.<\/p>\n\n\n\n<p>Par le quatri\u00e8me moyen, la soci\u00e9t\u00e9 contestait que la Cour territoriale avait pr\u00e9sum\u00e9 la bonne r\u00e9ception du fax sur la base du seul \u00e9l\u00e9ment disponible relatif \u00e0 l\u2019envoi effectif du fax.<\/p>\n\n\n\n<p>La Cassation a affirm\u00e9 que \u00ab l\u2019obligation du salari\u00e9 se limite \u00e0 v\u00e9rifier la bonne transmission du fax \u00bb, affirmant donc que \u00ab le comportement du salari\u00e9 est donc exempt de reproches \u00bb.<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale publi\u00e9e sur\u00a0<a href=\"https:\/\/ntpluslavoro.ilsole24ore.com\/art\/comunicazione-malattia-contratta-estero-valida-comunicazione-via-fax-AGvE0VL\">Norme e Tributi Plus Lavoro\u00a0del Il Sole 24 Ore.<\/a><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019envoi du certificat m\u00e9dical par fax constitue un mode valide de communication de la maladie par le salari\u00e9, d\u00e8s lors qu\u2019il est express\u00e9ment pr\u00e9vu par le r\u00e8glement interne de l\u2019entreprise.
