{"id":28607,"date":"2025-05-02T09:43:09","date_gmt":"2025-05-02T07:43:09","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/recesso-in-prova-ricorso-entro-cinque-anni-3\/"},"modified":"2026-02-16T16:36:14","modified_gmt":"2026-02-16T15:36:14","slug":"recesso-in-prova-ricorso-entro-cinque-anni","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/recesso-in-prova-ricorso-entro-cinque-anni\/","title":{"rendered":"P\u00e9riode d\u2019essai : recours contre la rupture dans les cinq ans"},"content":{"rendered":"\n<p>Avec l\u2019ordonnance tr\u00e8s r\u00e9cente n\u00b0 9282 du 8 avril 2025, la Cour de cassation italienne a \u00e9tabli que, pour les travailleurs engag\u00e9s \u00e0 l\u2019essai, la r\u00e9glementation sur les licenciements individuels (loi n\u00b0 604\/1966, modifi\u00e9e en 2010) ne s\u2019applique que dans le cas o\u00f9 l\u2019embauche devient d\u00e9finitive, et en tout \u00e9tat de cause uniquement apr\u00e8s six mois \u00e0 compter du d\u00e9but de la relation de travail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits examin\u00e9s<\/strong><\/h2>\n\n\n\n<p>Une entreprise avait d\u00e9cid\u00e9 de rompre le contrat de travail pendant la p\u00e9riode d\u2019essai, au motif que le salari\u00e9 n\u2019avait pas satisfait aux exigences de cette p\u00e9riode.<\/p>\n\n\n\n<p>Le salari\u00e9 avait contest\u00e9 la rupture durant la p\u00e9riode d\u2019essai dans les d\u00e9lais pr\u00e9vus pour l\u2019impugnation extrajudiciaire, en sollicitant une tentative de conciliation (refus\u00e9e par l\u2019employeur), mais sans respecter le d\u00e9lai pour le d\u00e9p\u00f4t de la requ\u00eate judiciaire.<\/p>\n\n\n\n<p>La Cour d\u2019appel de Venise, confirmant le jugement de premi\u00e8re instance, avait d\u00e9clar\u00e9 que le recours du salari\u00e9 avait \u00e9t\u00e9 d\u00e9pos\u00e9 au-del\u00e0 du d\u00e9lai de forclusion pr\u00e9vu par l\u2019article 6 de la loi n\u00b0 604\/1966. Selon cette disposition, en effet, la contestation du licenciement devient inefficace si elle n\u2019est pas suivie, dans les soixante jours suivant l\u2019\u00e9chec de la tentative de conciliation, du d\u00e9p\u00f4t d\u2019une action en justice.<\/p>\n\n\n\n<p>Le salari\u00e9 avait alors port\u00e9 l\u2019affaire devant la Cour de cassation, en soutenant que la loi n\u00b0 604\/1966 ne s\u2019appliquait pas \u00e0 sa situation, puisque, selon l\u2019article 10 de cette m\u00eame loi (modifi\u00e9 par la loi n\u00b0 183\/2010), les r\u00e8gles relatives au licenciement ne s\u2019appliquent que lorsque l\u2019embauche devient d\u00e9finitive ou, en tout \u00e9tat de cause, apr\u00e8s six mois de relation de travail.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/05\/shutterstock_1713676327-1024x608.jpg\" alt=\"\" class=\"wp-image-20398\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision<\/strong><\/h2>\n\n\n\n<p>La Cour de cassation, par l\u2019ordonnance n\u00b0 9282\/2025, a fait droit au pourvoi du salari\u00e9, affirmant que les juges du fond avaient appliqu\u00e9 de mani\u00e8re erron\u00e9e la r\u00e9glementation sur les licenciements individuels (art. 6 de la loi 604\/1966), sans tenir compte de la sp\u00e9cificit\u00e9 du contrat de travail \u00e0 l\u2019essai.<\/p>\n\n\n\n<p>La Cour a pr\u00e9cis\u00e9 que la rupture pendant la p\u00e9riode d\u2019essai ne rel\u00e8ve pas des cas de licenciement soumis au r\u00e9gime de d\u00e9ch\u00e9ance pr\u00e9vu par l\u2019article 6 de la loi 604\/1966 et par l\u2019article 32 de la loi 183\/2010.<\/p>\n\n\n\n<p>Cela tient au fait que la clause d\u2019essai a une nature diff\u00e9rente, destin\u00e9e \u00e0 permettre aux deux parties d\u2019\u00e9valuer la convenance r\u00e9ciproque de la relation de travail, et qu\u2019elle ob\u00e9it donc \u00e0 une logique de flexibilit\u00e9 accrue.<\/p>\n\n\n\n<p>Dans ces situations, conclut la Cour, c\u2019est la prescription ordinaire de cinq ans qui s\u2019applique, et non les d\u00e9lais de d\u00e9ch\u00e9ance pr\u00e9vus pour les licenciements ordinaires.<\/p>\n\n\n\n<p>Pour ces raisons, la Cassation a cass\u00e9 l\u2019arr\u00eat de la Cour d\u2019appel, renvoyant l\u2019affaire devant la juridiction de fond pour une nouvelle appr\u00e9ciation, en tenant compte de la sp\u00e9cificit\u00e9 de la rupture intervenue pendant la p\u00e9riode d\u2019essai.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Avec l\u2019ordonnance tr\u00e8s r\u00e9cente n\u00b0 9282 du 8 avril 2025, la Cour de cassation italienne a \u00e9tabli que, pour les travailleurs engag\u00e9s \u00e0 l\u2019essai, la r\u00e9glementation sur les licenciements individuels (loi n\u00b0 604\/1966, modifi\u00e9e en 2010) ne s\u2019applique que dans le cas o\u00f9 l\u2019embauche devient d\u00e9finitive, et en tout \u00e9tat de cause uniquement apr\u00e8s six [&hellip;]<\/p>\n","protected":false},"author":5,"featured_media":28608,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[175,190,192],"tags":[1006],"class_list":{"0":"post-28607","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","6":"hentry","7":"category-insights","9":"category-legislation","10":"tag-licenziamento-fr"},"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>P\u00e9riode d\u2019essai : recours contre la rupture dans les cinq ans - De Luca &amp;
