{"id":28619,"date":"2025-07-03T06:57:05","date_gmt":"2025-07-03T04:57:05","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/lavoro-agile-e-foro-competente-3\/"},"modified":"2026-02-16T16:36:31","modified_gmt":"2026-02-16T15:36:31","slug":"lavoro-agile-e-foro-competente","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/travail-agile\/","title":{"rendered":"Travail agile et tribunal comp\u00e9tent"},"content":{"rendered":"\n<p>Par l\u2019arr\u00eat n\u00b0 315 du 5 juin 2025, le Tribunal de Vicence a affirm\u00e9 qu\u2019aux fins de la comp\u00e9tence territoriale, la r\u00e9sidence du travailleur en t\u00e9l\u00e9travail ne peut \u00eatre pertinente que s\u2019il ressort que, \u00e0 son domicile, est exerc\u00e9e de mani\u00e8re stable et organis\u00e9e une partie essentielle de l\u2019activit\u00e9 professionnelle, de nature \u00e0 y localiser l\u2019ex\u00e9cution de la prestation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits en cause<\/strong><\/h2>\n\n\n\n<p>En contestant en justice le licenciement prononc\u00e9 \u00e0 son encontre par l\u2019employeur, le travailleur \u2013 exer\u00e7ant des fonctions de \u00ab commercial externe \u00bb \u2013 introduisait l\u2019instance devant le juge du lieu o\u00f9 il r\u00e9sidait et o\u00f9 il utilisait l\u2019ordinateur portable et le t\u00e9l\u00e9phone mobile qui lui avaient \u00e9t\u00e9 fournis par l\u2019entreprise.<\/p>\n\n\n\n<p>Dans le cadre de sa constitution en justice, la soci\u00e9t\u00e9 employeur soulevait, \u00e0 titre pr\u00e9liminaire, l\u2019incomp\u00e9tence territoriale du juge saisi.<\/p>\n\n\n\n<figure class=\"wp-block-gallery has-nested-images columns-default is-cropped wp-block-gallery-1 is-layout-flex wp-block-gallery-is-layout-flex\">\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" data-id=\"16986\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/11\/shutterstock_1726274593-1024x683.jpg\" alt=\"\" class=\"wp-image-16986\"\/><\/figure>\n<\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le jugement<\/strong><\/h2>\n\n\n\n<p>Face \u00e0 l\u2019exception soulev\u00e9e par la soci\u00e9t\u00e9 d\u00e9fenderesse, le Tribunal rappelait, en premier lieu, la disposition de l\u2019art. 413, al. 2, du Code de proc\u00e9dure civile qui, comme on le sait, rattache la comp\u00e9tence territoriale \u00e0 trois crit\u00e8res alternatifs, \u00e0 savoir la circonscription dans laquelle (i) la relation de travail est n\u00e9e, (ii) se trouve l\u2019entreprise ou (iii) l\u2019un de ses \u00e9tablissements auquel le travailleur est affect\u00e9 ou aupr\u00e8s duquel il exer\u00e7ait son activit\u00e9 au moment de la fin de la relation.<\/p>\n\n\n\n<p>En se r\u00e9f\u00e9rant \u00e0 la jurisprudence de l\u00e9gitimit\u00e9, le Tribunal soulignait en outre la n\u00e9cessit\u00e9 d\u2019interpr\u00e9ter de mani\u00e8re extensive la notion d\u2019\u00e9tablissement de l\u2019entreprise, afin de permettre \u00ab de rendre le proc\u00e8s plus fonctionnel et plus rapide, en l\u2019ancrant dans les lieux normalement les plus proches de la r\u00e9sidence du salari\u00e9, o\u00f9 les \u00e9l\u00e9ments de preuve n\u00e9cessaires au jugement sont plus facilement accessibles (Cass. n\u00b0 506\/2019 ; Cass. n\u00b0 6458\/2018) \u00bb.<\/p>\n\n\n\n<p>Ceci \u00e9tant pos\u00e9, le Tribunal pr\u00e9cisait que, dans tous les cas, \u00ab il faut toujours l\u2019existence d\u2019un lien objectif ou subjectif entre le lieu o\u00f9 le travailleur accomplit sa prestation et l\u2019organisation de l\u2019entreprise \u00bb.<\/p>\n\n\n\n<p>Il convient en effet de consid\u00e9rer que lorsque l\u2019activit\u00e9 en t\u00e9l\u00e9travail peut \u00eatre exerc\u00e9e de mani\u00e8re interchangeable dans n\u2019importe quel lieu, sans qu\u2019il ressorte de l\u2019habitation du travailleur \u00ab aucun autre \u00e9l\u00e9ment (ou lien objectif ou subjectif, comme indiqu\u00e9 ci-dessus) qui la caract\u00e9riserait en tant qu\u2019\u00e9tablissement de l\u2019entreprise, au sens d\u00e9fini \u00bb, alors ce crit\u00e8re ne peut \u00eatre pris en consid\u00e9ration pour d\u00e9terminer la comp\u00e9tence territoriale, ne restant que les crit\u00e8res du lieu de conclusion du contrat (\u2026) ou du si\u00e8ge o\u00f9 le travailleur \u00e9tait affect\u00e9 (\u2026).<\/p>\n\n\n\n<p>Sur ces bases, le Tribunal de Vicence \u2013 ne consid\u00e9rant pas \u00e9tabli qu\u2019au domicile du requ\u00e9rant f\u00fbt organis\u00e9e et exerc\u00e9e de mani\u00e8re stable une partie essentielle de sa prestation, de nature \u00e0 ancrer suffisamment solidement l\u2019activit\u00e9 \u00e0 ce lieu \u2013 a accueilli l\u2019exception d\u2019incomp\u00e9tence territoriale soulev\u00e9e par la soci\u00e9t\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par l\u2019arr\u00eat n\u00b0 315 du 5 juin 2025, le Tribunal de Vicence a affirm\u00e9 qu\u2019aux fins de la comp\u00e9tence territoriale, la r\u00e9sidence du travailleur en t\u00e9l\u00e9travail ne peut \u00eatre pertinente que s\u2019il ressort que, \u00e0 son domicile, est exerc\u00e9e de mani\u00e8re stable et organis\u00e9e une partie essentielle de l\u2019activit\u00e9 professionnelle, de nature \u00e0 y localiser [&hellip;]<\/p>\n","protected":false},"author":5,"featured_media":28620,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[175,190,192,198,212],"tags":[1006,1135],"class_list":{"0":"post-28619","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","6":"hentry","7":"category-insights","9":"category-legislation","10":"category-news","12":"tag-licenziamento-fr","13":"tag-smart-working-fr"},"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Travail agile et tribunal comp\u00e9tent - De Luca &amp;
