{"id":30303,"date":"2026-03-10T14:25:46","date_gmt":"2026-03-10T13:25:46","guid":{"rendered":"https:\/\/www.delucapartners.it\/news-fr\/trasferimento-quando-vi-sia-incompatibilita-con-il-contesto\/"},"modified":"2026-04-07T17:09:26","modified_gmt":"2026-04-07T15:09:26","slug":"le-transfert-du-salarie-est-legitime-en-presence-dune-incompatibilite","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/trasferimento-quando-vi-sia-incompatibilita-con-il-contesto\/","title":{"rendered":"Le transfert du salari\u00e9 est l\u00e9gitime en pr\u00e9sence d\u2019une incompatibilit\u00e9 avec l\u2019environnement de travail au sein de l\u2019entreprise (Camera di Commercio Italo-Francese, 10 marzo 2026 \u2013 Vittorio De Luca, Silvia Zulato)"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Par l\u2019ordonnance n\u00b0 4198 du 25 f\u00e9vrier 2026, la Cour de cassation \u2013 chambre sociale<strong> <\/strong>&#8211; a r\u00e9affirm\u00e9 qu\u2019une situation d\u2019incompatibilit\u00e9 environnementale peut justifier le transfert d\u2019un salari\u00e9 lorsque cette situation affecte n\u00e9gativement le d\u00e9roulement r\u00e9gulier de l\u2019activit\u00e9 de l\u2019entreprise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019affaire trouve son origine dans le transfert d\u2019une salari\u00e9e employ\u00e9e dans le cadre d\u2019un contrat de sous-traitance, d\u00e9plac\u00e9e de l\u2019\u00e9tablissement de la soci\u00e9t\u00e9 donneuse d\u2019ordre vers les bureaux de la coop\u00e9rative qui l\u2019employait. La mesure avait \u00e9t\u00e9 adopt\u00e9e apr\u00e8s que la soci\u00e9t\u00e9 donneuse d\u2019ordre avait manifest\u00e9 son indisponibilit\u00e9 \u00e0 poursuivre la collaboration avec la salari\u00e9e, allant jusqu\u2019\u00e0 lui retirer le badge n\u00e9cessaire pour acc\u00e9der \u00e0 l\u2019\u00e9tablissement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour d\u2019appel de Florence avait annul\u00e9 le transfert, estimant que le changement d\u00e9finitif du lieu de travail constituait un transfert ill\u00e9gitime en l\u2019absence de besoins organisationnels d\u00fbment \u00e9tablis.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Diritto-tributario-del-lavoro-1024x683.jpg\" alt=\"\" class=\"wp-image-29573\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Diritto-tributario-del-lavoro-1024x683.jpg 1024w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Diritto-tributario-del-lavoro-300x200.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Diritto-tributario-del-lavoro-768x512.jpg 768w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Diritto-tributario-del-lavoro-1536x1024.jpg 1536w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Diritto-tributario-del-lavoro.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation a censur\u00e9 cette d\u00e9cision. En premier lieu, les juges de l\u00e9gitimit\u00e9 ont pr\u00e9cis\u00e9 que toute modification du lieu de travail ne constitue pas automatiquement un transfert au sens technique du terme. Pour qu\u2019il puisse \u00eatre qualifi\u00e9 de transfert, il est en effet n\u00e9cessaire que le salari\u00e9 soit d\u00e9plac\u00e9 d\u2019une unit\u00e9 de production \u00e0 une autre, c\u2019est-\u00e0-dire entre des \u00e9tablissements de l\u2019entreprise dot\u00e9s d\u2019une autonomie organisationnelle et fonctionnelle propre. \u00c0 l\u2019inverse, lorsque la modification concerne uniquement le lieu concret d\u2019ex\u00e9cution de la prestation au sein de la m\u00eame structure d\u2019entreprise ou entre des articulations organisationnelles qui ne constituent pas des unit\u00e9s de production autonomes, le d\u00e9placement ne constitue pas un v\u00e9ritable transfert.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sous un autre angle, la Haute juridiction a rappel\u00e9 que parmi les motifs organisationnels susceptibles de justifier un transfert figure \u00e9galement la situation d\u2019incompatibilit\u00e9 environnementale. Cette hypoth\u00e8se se produit lorsque le comportement du salari\u00e9, bien qu\u2019il ne constitue pas n\u00e9cessairement une faute disciplinaire, entra\u00eene un dysfonctionnement organisationnel ou affecte n\u00e9gativement le d\u00e9roulement normal de l\u2019activit\u00e9 professionnelle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dans de telles circonstances, le transfert ne rev\u00eat pas une nature sanctionnatrice, mais constitue une mesure organisationnelle relevant de l\u2019appr\u00e9ciation de l\u2019employeur. Le contr\u00f4le du juge doit donc se limiter \u00e0 v\u00e9rifier l\u2019existence effective des exigences organisationnelles invoqu\u00e9es, sans pouvoir s\u2019\u00e9tendre \u00e0 l\u2019appr\u00e9ciation de l\u2019opportunit\u00e9 du choix entrepreneurial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En l\u2019esp\u00e8ce, la Cour de cassation a estim\u00e9 que la perte de confiance manifest\u00e9e par la soci\u00e9t\u00e9 donneuse d\u2019ordre \u00e0 l\u2019\u00e9gard de la salari\u00e9e, avec l\u2019impossibilit\u00e9 qui en r\u00e9sultait de poursuivre l\u2019activit\u00e9 au sein de l\u2019\u00e9tablissement, pouvait \u00e9galement engendrer une situation d\u2019incompatibilit\u00e9 de nature \u00e0 justifier le transfert d\u00e9cid\u00e9 par l\u2019employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La d\u00e9cision confirme ainsi que le transfert peut constituer un instrument l\u00e9gitime de gestion organisationnelle de l\u2019entreprise lorsqu\u2019il vise \u00e0 r\u00e9soudre des situations d\u2019incompatibilit\u00e9 environnementale susceptibles de compromettre le bon fonctionnement de l\u2019activit\u00e9 de l\u2019entreprise.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par l\u2019ordonnance n\u00b0 4198 du 25 f\u00e9vrier 2026, la Cour de cassation \u2013 chambre sociale &#8211; a r\u00e9affirm\u00e9 qu\u2019une situation d\u2019incompatibilit\u00e9 environnementale peut justifier le transfert d\u2019un salari\u00e9 lorsque cette situation affecte n\u00e9gativement le d\u00e9roulement r\u00e9gulier de l\u2019activit\u00e9 de l\u2019entreprise.
