Dans la pratique op\u00e9rationnelle, ces termes sont souvent utilis\u00e9s presque comme des synonymes. D\u2019un point de vue juridique, cependant, ils ne le sont absolument pas.<\/p>\n\n\n\n<p>Une r\u00e9cente ordonnance de la Cour de cassation (n\u00b0 1835 du 27 janvier 2026) attire l\u2019attention sur une distinction qui peut avoir des effets tr\u00e8s concrets dans la gestion des relations de travail : celle entre repos et inactivit\u00e9.<\/p>\n\n\n\n<p>La diff\u00e9rence n\u2019est pas seulement terminologique. Dans ce cas, la p\u00e9riode n\u2019est pas comptabilis\u00e9e comme temps de travail.<\/p>\n\n\n\n<p>La situation est diff\u00e9rente en cas de simple inactivit\u00e9 temporaire. Ici, bien que le salari\u00e9 n\u2019ex\u00e9cute pas de t\u00e2ches op\u00e9rationnelles, il est n\u00e9anmoins tenu de rester disponible pour r\u00e9pondre \u00e0 d\u2019\u00e9ventuelles demandes ou pour reprendre son activit\u00e9.
