En exer\u00e7ant les droits pr\u00e9vus par la r\u00e9glementation, il a demand\u00e9 \u00e0 l\u2019entreprise la d\u00e9sactivation du compte, le transfert des messages re\u00e7us pendant la p\u00e9riode d\u2019inactivit\u00e9 vers son adresse personnelle, ainsi que l\u2019activation d\u2019une r\u00e9ponse automatique pour informer les exp\u00e9diteurs de sa nouvelle adresse e-mail. Toutefois, ces demandes, correctement formul\u00e9es conform\u00e9ment au RGPD, n\u2019ont pas \u00e9t\u00e9 satisfaites.<\/p>\n\n\n\n<p>L\u2019Autorit\u00e9 r\u00e9affirme un principe fondamental : les demandes d\u2019exercice des droits pr\u00e9vus par la r\u00e9glementation en mati\u00e8re de protection des donn\u00e9es doivent toujours \u00eatre trait\u00e9es dans les d\u00e9lais l\u00e9gaux, m\u00eame lorsqu\u2019elles s\u2019inscrivent dans un contexte de contentieux du travail. Le fait que la demande soit formul\u00e9e de mani\u00e8re \u00ab non technique \u00bb ou que la relation soit conflictuelle ne dispense pas l\u2019employeur de son obligation de r\u00e9pondre dans un d\u00e9lai de 30 jours.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"932\" height=\"924\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/DLP-Case-History-3.jpg\" alt=\"\" class=\"wp-image-29709\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/DLP-Case-History-3.jpg 932w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/DLP-Case-History-3-300x297.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/DLP-Case-History-3-150x150.jpg 150w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/DLP-Case-History-3-768x761.jpg 768w\" sizes=\"auto, (max-width: 932px) 100vw, 932px\" \/><\/figure>\n\n\n\n<p>En revenant sur la question de la gestion du compte de messagerie professionnelle d\u2019un ancien salari\u00e9, il convient de souligner l\u2019importance du rappel \u00e0 une orientation jurisprudentielle constante \u2013 tant nationale qu\u2019europ\u00e9enne \u2013 selon laquelle la protection de la vie priv\u00e9e et de la correspondance s\u2019\u00e9tend \u00e9galement au cadre professionnel.<\/p>\n\n\n\n<p>Le compte de messagerie peut en effet contenir des donn\u00e9es personnelles et des communications relevant du champ de protection de l\u2019article 8 de la CEDH, m\u00eame lorsqu\u2019il est utilis\u00e9 \u00e0 des fins professionnelles.<\/p>\n\n\n\n<p>Il s\u2019ensuit que l\u2019acc\u00e8s, le transfert ou la conservation des messages apr\u00e8s la cessation de la relation de travail constituent des traitements de donn\u00e9es \u00e0 caract\u00e8re personnel qui doivent respecter les principes de :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>lic\u00e9it\u00e9 ;<\/li>\n\n\n\n<li>minimisation ;<\/li>\n\n\n\n<li>limitation de la conservation.<\/li>\n<\/ul>\n\n\n\n<p>L\u2019Autorit\u00e9 pr\u00e9cise que les exigences de continuit\u00e9 de l\u2019activit\u00e9 ne justifient pas automatiquement le maintien actif de la bo\u00eete e-mail d\u2019un ancien salari\u00e9.<\/p>\n\n\n\n<p>La bonne pratique consiste plut\u00f4t \u00e0 :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>d\u00e9sactiver rapidement le compte ;<\/li>\n\n\n\n<li>activer des r\u00e9ponses automatiques \u00e0 destination des tiers ;<\/li>\n\n\n\n<li>\u00e9viter l\u2019acc\u00e8s au contenu des communications, sauf dans des cas exceptionnels et d\u00fbment motiv\u00e9s.<\/li>\n<\/ul>\n\n\n\n<p>Dans le cas examin\u00e9, l\u2019Autorit\u00e9 a constat\u00e9 plusieurs violations du RGPD et a inflig\u00e9 une amende administrative de 40 000 euros, tout en ordonnant des mesures correctrices ainsi que la publication de la d\u00e9cision.<\/p>\n\n\n\n<p>Cette d\u00e9cision constitue un avertissement important : la gestion des outils num\u00e9riques professionnels apr\u00e8s la fin de la relation de travail n\u00e9cessite des proc\u00e9dures claires, \u00e0 jour et pleinement conformes \u00e0 la r\u00e9glementation en mati\u00e8re de protection des donn\u00e9es.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019Autorit\u00e9 de protection des donn\u00e9es a de nouveau exprim\u00e9 son point de vue sur la gestion de la messagerie \u00e9lectronique professionnelle par les employeurs apr\u00e8s la cessation de la relation de travail, en fournissant des indications pratiques pr\u00e9cieuses aux entreprises et aux responsables des ressources humaines.
