Le contenu du message avait ensuite \u00e9t\u00e9 diffus\u00e9 \u00e0 l\u2019ext\u00e9rieur, devenant accessible sur une page Facebook.<\/p>\n\n\n\n<p>La Cour d\u2019appel de Venise avait jug\u00e9 le licenciement l\u00e9gitime, en tenant compte de la gravit\u00e9 globale du comportement, du poste occup\u00e9 par la salari\u00e9e ainsi que du pr\u00e9judice potentiel pour l\u2019organisation de l\u2019entreprise et pour les mesures de s\u00e9curit\u00e9 adopt\u00e9es.<\/p>\n\n\n\n<p>La Cour de cassation a confirm\u00e9 cette d\u00e9cision. En premier lieu, les juges ont exclu que le caract\u00e8re \u00ab priv\u00e9 \u00bb du chat WhatsApp soit en soi suffisant pour \u00e9carter la port\u00e9e disciplinaire du comportement. Le fait que la communication ait eu lieu au sein d\u2019un groupe implique en effet la pr\u00e9sence de plusieurs destinataires, pouvant \u00eatre qualifi\u00e9s de tiers par rapport \u00e0 l\u2019auteur de la d\u00e9claration.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"674\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/3.1-1024x674.jpg\" alt=\"\" class=\"wp-image-29919\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/3.1-1024x674.jpg 1024w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/3.1-300x198.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/3.1-768x506.jpg 768w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2025\/01\/3.1.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>Sous un autre angle, la Haute juridiction a accord\u00e9 une importance particuli\u00e8re au contenu du message, consid\u00e9r\u00e9 comme marqu\u00e9 par une intention manifestement pr\u00e9judiciable. Les propos offensants \u00e0 l\u2019\u00e9gard de coll\u00e8gues et de sup\u00e9rieurs, conjugu\u00e9s \u00e0 la diffusion d\u2019informations internes confidentielles et \u00e0 l\u2019indication de moyens de contourner des proc\u00e9dures internes, ont \u00e9t\u00e9 jug\u00e9s de nature \u00e0 compromettre de mani\u00e8re significative la relation de confiance.<\/p>\n\n\n\n<p>La Cour a en outre distingu\u00e9 entre la volont\u00e9 de formuler la d\u00e9claration au sein du chat et la diffusion ult\u00e9rieure du message \u00e0 l\u2019ext\u00e9rieur. En particulier, les juges ont pr\u00e9cis\u00e9 que, m\u00eame en l\u2019absence de preuve d\u2019une volont\u00e9 de diffusion, la pr\u00e9visibilit\u00e9 de la circulation du contenu en dehors du groupe suffit \u00e0 fonder un \u00e9l\u00e9ment de responsabilit\u00e9, contribuant \u00e0 accro\u00eetre la gravit\u00e9 globale du comportement.<\/p>\n\n\n\n<p>Dans cette perspective, le fait que la communication ait eu lieu au moyen d\u2019un outil relevant de la sph\u00e8re priv\u00e9e n\u2019a pas \u00e9t\u00e9 jug\u00e9 de nature \u00e0 neutraliser la port\u00e9e disciplinaire du comportement, en particulier lorsque le contenu du message pr\u00e9sente un caract\u00e8re objectivement pr\u00e9judiciable pour l\u2019organisation de l\u2019entreprise.<\/p>\n\n\n\n<p>La d\u00e9cision confirme ainsi que m\u00eame les communications effectu\u00e9es au sein de chats priv\u00e9s peuvent rev\u00eatir une port\u00e9e disciplinaire et justifier un licenciement, d\u00e8s lors qu\u2019elles sont susceptibles de porter atteinte aux int\u00e9r\u00eats de l\u2019employeur et de compromettre gravement le lien de confiance.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Con l\u2019ordonnance n\u00b0 7982 du 31 mars 2026, la Cour de cassation, chambre sociale, a affirm\u00e9 qu\u2019un message envoy\u00e9 au sein d\u2019un chat priv\u00e9 peut constituer une cause r\u00e9elle et s\u00e9rieuse de licenciement lorsque, par son contenu et ses modalit\u00e9s de diffusion, il est susceptible de porter atteinte \u00e0 la relation de confiance avec l\u2019employeur.
