Le salari\u00e9 avait contest\u00e9 cette d\u00e9cision, invoquant la nullit\u00e9 de la clause de p\u00e9riode d\u2019essai en raison de l\u2019absence d\u2019indication des fonctions et demandant notamment r\u00e9paration du pr\u00e9judice subi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019employeur, quant \u00e0 lui, soutenait que l\u2019exigence de pr\u00e9cision \u00e9tait en tout \u00e9tat de cause satisfaite par le renvoi \u00e0 la convention collective nationale applicable (CCNL) et \u00e0 l\u2019avis de recrutement, estim\u00e9s suffisants pour rendre le contenu de la prestation de travail d\u00e9terminable.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"579\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Compliance-responsabilita-amministrativa-degli-enti-1024x579.jpg\" alt=\"\" class=\"wp-image-29606\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Compliance-responsabilita-amministrativa-degli-enti-1024x579.jpg 1024w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Compliance-responsabilita-amministrativa-degli-enti-300x170.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Compliance-responsabilita-amministrativa-degli-enti-768x434.jpg 768w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Compliance-responsabilita-amministrativa-degli-enti-1536x869.jpg 1536w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Compliance-responsabilita-amministrativa-degli-enti.jpg 1680w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Les juges de premi\u00e8re instance ont fait droit au recours, en relevant que la clause de p\u00e9riode d\u2019essai, au sens de l\u2019article 2096 du code civil italien, exige une indication pr\u00e9cise des fonctions devant faire l\u2019objet de l\u2019\u00e9valuation. Cette exigence peut \u00eatre satisfaite \u00e9galement par une r\u00e9f\u00e9rence <em>per relationem<\/em>, \u00e0 condition que celle-ci soit suffisamment sp\u00e9cifique pour permettre l\u2019identification concr\u00e8te des activit\u00e9s \u00e0 accomplir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En l\u2019esp\u00e8ce, cette condition n\u2019a pas \u00e9t\u00e9 jug\u00e9e remplie : ni le contrat individuel, ni l\u2019avis de recrutement, ni la r\u00e9f\u00e9rence au classement conventionnel ne permettaient d\u2019identifier de mani\u00e8re pr\u00e9cise les t\u00e2ches confi\u00e9es au salari\u00e9 durant la p\u00e9riode d\u2019essai, ces documents se limitant \u00e0 des descriptions g\u00e9n\u00e9riques de cat\u00e9gories professionnelles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le juge a \u00e9galement relev\u00e9 que le salari\u00e9 avait d\u00e9j\u00e0 exerc\u00e9 des activit\u00e9s analogues dans le cadre d\u2019un pr\u00e9c\u00e9dent stage aupr\u00e8s du m\u00eame employeur, circonstance qui renfor\u00e7ait la n\u00e9cessit\u00e9 d\u2019une d\u00e9limitation claire de l\u2019objet de l\u2019essai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La nullit\u00e9 de la clause de p\u00e9riode d\u2019essai ayant \u00e9t\u00e9 constat\u00e9e, le licenciement prononc\u00e9 par l\u2019employeur a \u00e9t\u00e9 jug\u00e9 ill\u00e9gitime.
