{"id":31633,"date":"2026-04-27T21:28:59","date_gmt":"2026-04-27T19:28:59","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/naspi-e-dimissioni-per-trasferimento-oltre-50km\/"},"modified":"2026-05-06T14:19:55","modified_gmt":"2026-05-06T12:19:55","slug":"la-naspi-et-la-demission-pour-transfert-a-plus-de-50-km","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/la-naspi-et-la-demission-pour-transfert-a-plus-de-50-km\/","title":{"rendered":"La NASpI et la d\u00e9mission pour transfert \u00e0 plus de 50 km : selon la Cour de cassation italienne, la seule distance ne suffit pas, il faut prouver le manquement de l\u2019employeur."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Avec l\u2019ordonnance n\u00b0 10559 du 21 avril 2026, la Cour de cassation italienne s\u2019est prononc\u00e9e en mati\u00e8re d\u2019indemnit\u00e9 de ch\u00f4mage (NASpI) \u00e0 la suite de d\u00e9missions pour juste motif caus\u00e9es par la mutation du salari\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour a jug\u00e9 que la reconnaissance de la NASpI au salari\u00e9 d\u00e9missionnaire suppose que les d\u00e9missions aient \u00e9t\u00e9 prises pour juste motif au sens de l\u2019article 3, paragraphe 2, du d\u00e9cret l\u00e9gislatif n\u00b0 22\/2015. Cette disposition exige la constatation de circonstances imputables \u00e0 l\u2019employeur, constituant un manquement grave ou, en tout \u00e9tat de cause, un comportement rendant intol\u00e9rable la poursuite, m\u00eame temporaire, du contrat de travail. Par cons\u00e9quent, la seule distance importante r\u00e9sultant du transfert du lieu de travail ne suffit pas, \u00e0 elle seule, \u00e0 caract\u00e9riser le juste motif de d\u00e9mission et donc une situation de ch\u00f4mage involontaire ouvrant droit \u00e0 la NASpI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Les faits de l\u2019affaire<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le litige trouve son origine dans la demande d\u2019un salari\u00e9 tendant \u00e0 obtenir la NASpI \u00e0 la suite de sa d\u00e9mission pour juste motif, motiv\u00e9e par le transfert de son lieu de travail d\u00e9cid\u00e9 par l\u2019employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En premi\u00e8re instance, le tribunal comp\u00e9tent avait rejet\u00e9 la demande du salari\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par la suite, la Cour d\u2019appel de G\u00eanes, par l\u2019arr\u00eat n\u00b0 50\/2025, avait infirm\u00e9 la d\u00e9cision de premi\u00e8re instance en faisant droit aux arguments du salari\u00e9. La juridiction d\u2019appel avait estim\u00e9 que le transfert du lieu de travail \u00e0 une distance importante (de G\u00eanes \u00e0 Catane), sup\u00e9rieure \u00e0 50 km du domicile du salari\u00e9, constituait en soi un juste motif de rupture. Selon les juges d\u2019appel, une telle situation caract\u00e9risait une \u00ab situation objective grave ne permettant pas la poursuite du contrat \u00bb, sans qu\u2019il soit n\u00e9cessaire de constater un manquement effectif de l\u2019employeur.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"638\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/09\/HRO-\u2013-HR-Outsourcing-1024x638.jpg\" alt=\"\" class=\"wp-image-29579\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/09\/HRO-\u2013-HR-Outsourcing-1024x638.jpg 1024w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/09\/HRO-\u2013-HR-Outsourcing-300x187.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/09\/HRO-\u2013-HR-Outsourcing-768x478.jpg 768w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/09\/HRO-\u2013-HR-Outsourcing-1536x957.jpg 1536w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2023\/09\/HRO-\u2013-HR-Outsourcing.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de cassation<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019INPS a form\u00e9 un pourvoi en cassation contre l\u2019arr\u00eat de la Cour d\u2019appel. L\u2019institut de s\u00e9curit\u00e9 sociale a soutenu que la juridiction d\u2019appel avait commis une erreur en reconnaissant la juste cause des d\u00e9missions sans v\u00e9rifier au pr\u00e9alable l\u2019ill\u00e9galit\u00e9 du transfert, c\u2019est-\u00e0-dire l\u2019absence de \u00ab raisons techniques, organisationnelles et productives av\u00e9r\u00e9es \u00bb qui, au sens de l\u2019article 2103 du code civil italien, l\u00e9gitiment la mesure de l\u2019employeur. Selon l\u2019INPS, seul un transfert ill\u00e9gal peut constituer un manquement grave de l\u2019employeur justifiant des d\u00e9missions pour juste motif et, par cons\u00e9quent, le droit \u00e0 la NASpI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation a consid\u00e9r\u00e9 le moyen de l\u2019INPS comme fond\u00e9. Les juges de la Cour ont pr\u00e9cis\u00e9 que, pour obtenir la NASpI \u00e0 la suite de d\u00e9missions, il ne suffit pas de faire \u00e9tat d\u2019une situation g\u00e9n\u00e9rale de difficult\u00e9 : il est n\u00e9cessaire que les d\u00e9missions soient qualifi\u00e9es de \u00ab d\u00e9missions pour juste motif \u00bb au sens de l\u2019article 2119 du code civil. Cette notion suppose une cause rendant impossible la poursuite, m\u00eame temporaire, du contrat de travail, et imputable \u00e0 un manquement grave aux obligations contractuelles de l\u2019employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour a indiqu\u00e9 que la Cour d\u2019appel avait commis une erreur en se fondant exclusivement sur l\u2019\u00e9l\u00e9ment objectif de la distance importante du nouveau lieu de travail, sans proc\u00e9der \u00e0 la v\u00e9rification essentielle de l\u2019existence d\u2019un manquement de l\u2019employeur. En effet, le droit \u00e0 l\u2019indemnit\u00e9 de ch\u00f4mage est exclu lorsque le salari\u00e9 renonce volontairement \u00e0 son emploi alors qu\u2019il aurait la possibilit\u00e9 de poursuivre le contrat. Dans le cas d\u2019un transfert, cette possibilit\u00e9 subsiste lorsque le transfert est l\u00e9gitime, c\u2019est-\u00e0-dire fond\u00e9 sur de r\u00e9elles raisons techniques, organisationnelles et productives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par cons\u00e9quent, la Cour de cassation a jug\u00e9 que le juge du fond aurait d\u00fb v\u00e9rifier, afin de reconna\u00eetre le droit \u00e0 la NASpI, si le transfert \u00e9tait ill\u00e9gal et constituait donc un manquement de l\u2019employeur de nature \u00e0 rompre le lien de confiance et \u00e0 rendre intol\u00e9rable la poursuite du rapport de travail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour ces raisons, la Haute juridiction a cass\u00e9 la d\u00e9cision attaqu\u00e9e et renvoy\u00e9 l\u2019affaire devant la Cour d\u2019appel de G\u00eanes, autrement compos\u00e9e, afin qu\u2019elle proc\u00e8de \u00e0 un nouvel examen au fond, en se conformant au principe de droit \u00e9nonc\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Note<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il convient de rappeler que, par le message n\u00b0 369 du 26 janvier 2018, l\u2019INPS avait d\u00e9j\u00e0 pr\u00e9cis\u00e9 certains principes relatifs \u00e0 la perte involontaire d\u2019emploi aux fins de la reconnaissance de la NASpI, en admettant \u00e9galement le droit \u00e0 l\u2019indemnit\u00e9 dans le cas de la rupture consensuelle du contrat cons\u00e9cutive au refus du salari\u00e9 d\u2019un transfert vers une autre unit\u00e9 de l\u2019entreprise situ\u00e9e \u00e0 plus de 50 km de son domicile ou accessible en plus de 80 minutes en transports publics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ainsi, l\u2019INPS reconna\u00eet le droit \u00e0 la NASpI en cas de r\u00e9solution consensuelle du contrat li\u00e9e au transfert, mais pas en cas de d\u00e9mission pour juste motif \u00e0 la suite d\u2019un transfert (sauf preuve judiciaire d\u2019un manquement de l\u2019employeur).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation, dans l\u2019ordonnance comment\u00e9e, a adh\u00e9r\u00e9 aux principes indiqu\u00e9s par l\u2019INPS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Toutefois, il convient de pr\u00e9ciser qu\u2019une r\u00e9cente orientation de la jurisprudence de fond (Tribunal de Milan, arr\u00eat n\u00b0 4400 du 9 octobre 2024 ; Tribunal de Reggio de Calabre, arr\u00eat n\u00b0 1663 du 13 d\u00e9cembre 2024 ; Tribunal de Catane, arr\u00eat n\u00b0 973 du 4 mars 2025 ; Tribunal de Monza, arr\u00eat n\u00b0 582 du 6 mai 2025) a adopt\u00e9 une approche plus substantielle et contraire \u00e0 cette d\u00e9cision, reconnaissant le droit \u00e0 la NASpI m\u00eame en cas de d\u00e9missions pour juste motif li\u00e9es \u00e0 un transfert, sans n\u00e9cessit\u00e9 de prouver un manquement de l\u2019employeur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019argument principal de cette jurisprudence repose sur une possible discrimination par rapport \u00e0 l\u2019hypoth\u00e8se, admise par l\u2019INPS, de la rupture consensuelle du contrat. L\u2019institut reconna\u00eet en effet la NASpI lorsque le contrat est r\u00e9sili\u00e9 d\u2019un commun accord \u00e0 la suite du refus d\u2019un transfert situ\u00e9 \u00e0 plus de 50 km ou n\u00e9cessitant plus de 80 minutes de trajet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette jurisprudence consid\u00e8re donc qu\u2019il n\u2019existe aucune raison logique de traiter diff\u00e9remment les d\u00e9missions du salari\u00e9, fond\u00e9es sur les m\u00eames motifs objectifs de difficult\u00e9, par rapport \u00e0 la rupture consensuelle.
