Toute limitation doit \u00eatre justifi\u00e9e par des raisons sp\u00e9cifiques et av\u00e9r\u00e9es, telles que la protection de secrets d\u2019entreprise \u00bb. Tel est ce qu\u2019a \u00e9tabli l\u2019Autorit\u00e9 garante pour la protection des donn\u00e9es personnelles dans une d\u00e9cision du 12 mars 2026, rendue publique le 15 avril 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c0 la suite de la cessation de son contrat de travail, l\u2019ancien salari\u00e9 demandait \u00e0 la soci\u00e9t\u00e9 d\u2019acc\u00e9der \u00e0 ses documents et dossiers personnels pr\u00e9sents sur l\u2019ordinateur ainsi que dans sa bo\u00eete e-mail professionnelle nominative. Dans un premier temps, la soci\u00e9t\u00e9 avait autoris\u00e9 un acc\u00e8s partiel, permettant la r\u00e9cup\u00e9ration de fichiers depuis le bureau (desktop), mais pas depuis la messagerie \u00e9lectronique, pour des raisons techniques all\u00e9gu\u00e9es.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lors d\u2019un entretien ult\u00e9rieur, la soci\u00e9t\u00e9 avait remis uniquement la correspondance consid\u00e9r\u00e9e comme \u00ab strictement personnelle \u00bb (\u00e9changes avec des membres de la famille, certificats fiscaux, remboursements de frais), en excluant l\u2019ensemble des communications li\u00e9es \u00e0 l\u2019activit\u00e9 professionnelle.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/MA-e-operazioni-straordinarie-1024x683.jpg\" alt=\"\" class=\"wp-image-29582\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/MA-e-operazioni-straordinarie-1024x683.jpg 1024w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/MA-e-operazioni-straordinarie-300x200.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/MA-e-operazioni-straordinarie-768x512.jpg 768w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/MA-e-operazioni-straordinarie-1536x1024.jpg 1536w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/MA-e-operazioni-straordinarie.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Face \u00e0 cette limitation, l\u2019int\u00e9ress\u00e9 a formalis\u00e9 une demande d\u2019acc\u00e8s au titre de l\u2019article 15 du r\u00e8glement (UE) 2016\/679 (RGPD), sollicitant la copie de l\u2019ensemble des courriels pr\u00e9sents sur son compte professionnel \u00e0 partir d\u2019une certaine date. L\u2019entreprise a r\u00e9pondu en soutenant que la demande exc\u00e9dait le droit d\u2019acc\u00e8s, au motif que les informations contenues dans la messagerie relevaient de sa propri\u00e9t\u00e9, et que l\u2019acc\u00e8s devait se limiter aux seules donn\u00e9es personnelles de l\u2019int\u00e9ress\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019Autorit\u00e9 a jug\u00e9 ce comportement non conforme \u00e0 la r\u00e9glementation, rappelant que le droit d\u2019acc\u00e8s de la personne concern\u00e9e s\u2019\u00e9tend \u00e0 toutes les donn\u00e9es personnelles la concernant, ind\u00e9pendamment de leur qualification comme personnelles ou professionnelles :<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab Le contenu des messages \u00e9lectroniques \u2014 de m\u00eame que les donn\u00e9es externes des communications et les pi\u00e8ces jointes \u2014 concerne des formes de correspondance b\u00e9n\u00e9ficiant de garanties de secret prot\u00e9g\u00e9es \u00e9galement au niveau constitutionnel, dont la finalit\u00e9 est de prot\u00e9ger le noyau essentiel de la dignit\u00e9 humaine et le plein d\u00e9veloppement de la personnalit\u00e9 dans les formations sociales. \u00bb<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par cons\u00e9quent, les communications transitant sur un compte nominatif, m\u00eame de nature professionnelle, constituent des donn\u00e9es personnelles de l\u2019utilisateur du compte. La position de la soci\u00e9t\u00e9, selon laquelle ces communications rel\u00e8veraient de sa \u00ab disponibilit\u00e9 pleine et exclusive \u00bb, a \u00e9t\u00e9 qualifi\u00e9e de \u00ab conviction erron\u00e9e \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019activit\u00e9 de masquage et d\u2019anonymisation r\u00e9alis\u00e9e par la soci\u00e9t\u00e9 a \u00e9galement \u00e9t\u00e9 jug\u00e9e illicite. Bien que le RGPD pr\u00e9voie des limitations au droit d\u2019acc\u00e8s afin de prot\u00e9ger les droits et libert\u00e9s d\u2019autrui (y compris les secrets d\u2019affaires), le responsable du traitement doit d\u00e9montrer l\u2019existence d\u2019un pr\u00e9judice effectif et concret. En l\u2019esp\u00e8ce, la soci\u00e9t\u00e9 n\u2019a pas apport\u00e9 d\u2019\u00e9l\u00e9ments attestant d\u2019un tel risque, et l\u2019occultation des donn\u00e9es de tiers est apparue non n\u00e9cessaire, ces informations \u00e9tant d\u00e9j\u00e0 connues de la personne concern\u00e9e.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La d\u00e9cision met \u00e9galement en \u00e9vidence d\u2019autres criticit\u00e9s au regard de la conformit\u00e9 r\u00e9glementaire. Le Garante a relev\u00e9 des lacunes en mati\u00e8re de transparence des informations fournies et a estim\u00e9 disproportionn\u00e9es les dur\u00e9es de conservation adopt\u00e9es par la soci\u00e9t\u00e9 (cinq ans pour les e-mails et douze mois pour les donn\u00e9es de navigation), au regard des finalit\u00e9s d\u00e9clar\u00e9es.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Au vu des violations constat\u00e9es, l\u2019Autorit\u00e9 a inflig\u00e9 une sanction administrative de 50 000 euros et a ordonn\u00e9 \u00e0 la soci\u00e9t\u00e9 de permettre l\u2019acc\u00e8s int\u00e9gral aux donn\u00e9es demand\u00e9es ainsi que d\u2019adapter ses informations et politiques internes.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00ab Le salari\u00e9 peut acc\u00e9der aux messages de son compte e-mail professionnel ainsi qu\u2019aux documents pr\u00e9sents sur son ordinateur apr\u00e8s la fin du contrat de travail.
