{"id":31946,"date":"2026-07-02T11:03:56","date_gmt":"2026-07-02T09:03:56","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/omessa-contestazione-delladdebito-disciplinare-la-cassazione-esclude-la-nullita-del-licenziamento-e-la-reintegra-nelle-piccole-imprese\/"},"modified":"2026-07-02T11:14:03","modified_gmt":"2026-07-02T09:14:03","slug":"absence-de-notification-des-griefs-disciplinaires-la-cour-de-cassation-exclut-la-nullite-du-licenciement-et-la-reintegration-dans-les-petites-entreprises","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/absence-de-notification-des-griefs-disciplinaires-la-cour-de-cassation-exclut-la-nullite-du-licenciement-et-la-reintegration-dans-les-petites-entreprises\/","title":{"rendered":"Absence de notification des griefs disciplinaires : la Cour de cassation exclut la nullit\u00e9 du licenciement et la r\u00e9int\u00e9gration dans les petites entreprises"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>R\u00e9sum\u00e9<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat tr\u00e8s r\u00e9cent (n\u00b0 17283 du 1er juin 2026), la Cour de cassation s\u2019est prononc\u00e9e sur la question de l\u2019absence de notification des griefs disciplinaires et sur ses cons\u00e9quences quant au r\u00e9gime de protection applicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019absence totale de notification des griefs disciplinaires, prescrite comme garantie fondamentale du droit de la d\u00e9fense du salari\u00e9 par l\u2019article 7 de la loi n\u00b0 300\/1970, constitue certes une irr\u00e9gularit\u00e9 radicale entra\u00eenant l\u2019inexistence de l\u2019ensemble de la <a href=\"https:\/\/www.delucapartners.it\/fr\/insights\/legislation\/communication-du-licenciement-un-simple-courriel-est-suffisant-si-le-salarie-en-a-eu-connaissance\/\">proc\u00e9dure disciplinaire.<\/a> Toutefois, cette irr\u00e9gularit\u00e9 doit \u00eatre assimil\u00e9e \u00e0 l\u2019inexistence du fait reproch\u00e9 et ne saurait \u00eatre qualifi\u00e9e de \u00ab nullit\u00e9 \u00bb au sens de l\u2019article 2 du d\u00e9cret l\u00e9gislatif n\u00b0 23\/2015.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par cons\u00e9quent, une telle irr\u00e9gularit\u00e9 n\u2019ouvre pas droit \u00e0 la protection r\u00e9int\u00e9gratoire int\u00e9grale, ind\u00e9pendamment de l\u2019effectif de l\u2019employeur. Pour les employeurs ne remplissant pas les seuils d\u2019effectifs pr\u00e9vus \u00e0 l\u2019article 18 du Statut des travailleurs (les \u00ab petites entreprises \u00bb), le r\u00e9gime applicable demeure celui de l\u2019indemnisation, conform\u00e9ment \u00e0 l\u2019article 9 du d\u00e9cret l\u00e9gislatif n\u00b0 23\/2015, lequel exclut le recours \u00e0 la r\u00e9int\u00e9gration, y compris lorsque le fait reproch\u00e9 est consid\u00e9r\u00e9 comme inexistant.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"706\" src=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Contenzioso-lavoro-1024x706.jpg\" alt=\"\" class=\"wp-image-29555\" srcset=\"https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Contenzioso-lavoro-1024x706.jpg 1024w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Contenzioso-lavoro-300x207.jpg 300w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Contenzioso-lavoro-768x529.jpg 768w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Contenzioso-lavoro-1536x1058.jpg 1536w, https:\/\/www.delucapartners.it\/wp-content\/uploads\/2019\/12\/Contenzioso-lavoro.jpg 1920w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>La proc\u00e9dure au fond<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le litige trouve son origine dans le licenciement pour faute grave d\u2019un salari\u00e9 \u00e0 la suite d\u2019une absence injustifi\u00e9e d\u2019une dur\u00e9e de cinq jours.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Par un arr\u00eat r\u00e9formant partiellement le jugement de premi\u00e8re instance, la cour d\u2019appel a d\u00e9clar\u00e9 le licenciement ill\u00e9gitime, en relevant que l\u2019employeur avait totalement omis de notifier pr\u00e9alablement les griefs disciplinaires, comme l\u2019exige l\u2019article 7 du Statut des travailleurs. Selon les juges du fond, cette omission entra\u00eene l\u2019inexistence de la proc\u00e9dure disciplinaire, laquelle doit \u00eatre assimil\u00e9e \u00e0 l\u2019inexistence du fait reproch\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S\u2019agissant toutefois du r\u00e9gime de protection applicable, la cour d\u2019appel a consid\u00e9r\u00e9 comme d\u00e9terminant le d\u00e9faut du seuil d\u2019effectif requis dans le chef de l\u2019employeur. Ayant constat\u00e9 que la soci\u00e9t\u00e9 employait moins de quinze salari\u00e9s, elle a \u00e9cart\u00e9 l\u2019application de la protection r\u00e9int\u00e9gratoire \u00ab att\u00e9nu\u00e9e \u00bb et condamn\u00e9 l\u2019employeur au seul versement de dommages-int\u00e9r\u00eats, conform\u00e9ment au r\u00e9gime dit de la \u00ab protection obligatoire \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>L\u2019arr\u00eat de la Cour de cassation<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le salari\u00e9 s\u2019est pourvu en cassation, en invoquant un moyen unique tir\u00e9 de la violation de l\u2019article 2, paragraphe 1, du d\u00e9cret l\u00e9gislatif n\u00b0 23\/2015 ainsi que de l\u2019article 7 de la loi n\u00b0 300\/1970. Selon le requ\u00e9rant, l\u2019absence totale de notification des griefs disciplinaires, en ce qu\u2019elle m\u00e9conna\u00eet une disposition imp\u00e9rative garantissant les droits de la d\u00e9fense, devait entra\u00eener la nullit\u00e9 du licenciement. Une telle nullit\u00e9 aurait, selon lui, d\u00fb conduire \u00e0 l\u2019application de la protection r\u00e9int\u00e9gratoire int\u00e9grale, ind\u00e9pendamment de l\u2019effectif de l\u2019entreprise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation a rejet\u00e9 le pourvoi comme non fond\u00e9, en proc\u00e9dant \u00e0 une analyse approfondie de la nature de cette irr\u00e9gularit\u00e9 proc\u00e9durale et du r\u00e9gime de protection applicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour a tout d\u2019abord confirm\u00e9 une jurisprudence d\u00e9sormais bien \u00e9tablie selon laquelle, \u00ab en mati\u00e8re de licenciement disciplinaire, l\u2019absence totale de notification des griefs entra\u00eene l\u2019inexistence de l\u2019ensemble de la proc\u00e9dure disciplinaire, et non la simple violation des r\u00e8gles qui l\u2019encadrent, ce qui justifie l\u2019application de la protection r\u00e9int\u00e9gratoire pr\u00e9vue au quatri\u00e8me alin\u00e9a de l\u2019article 18 de la loi n\u00b0 300 de 1970, telle que modifi\u00e9e par la loi n\u00b0 92 de 2012 \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cette assimilation repose sur le fait que la notification des griefs constitue un \u00ab pr\u00e9alable logique et juridique indispensable \u00bb \u00e0 l\u2019appr\u00e9ciation de la l\u00e9gitimit\u00e9 m\u00eame du licenciement. En l\u2019absence d\u2019un \u00ab fait reproch\u00e9 \u00bb r\u00e9guli\u00e8rement port\u00e9 \u00e0 la connaissance du salari\u00e9, la rupture du contrat est radicalement d\u00e9pourvue de justification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour de cassation pr\u00e9cise toutefois avec nettet\u00e9 que cette irr\u00e9gularit\u00e9, aussi grave soit-elle, ne rel\u00e8ve pas de la cat\u00e9gorie des nullit\u00e9s ouvrant droit \u00e0 la r\u00e9int\u00e9gration ind\u00e9pendamment du seuil d\u2019effectif de l\u2019employeur. \u00c0 l\u2019appui de cette conclusion, elle se r\u00e9f\u00e8re \u00e0 une jurisprudence ancienne et constante, inaugur\u00e9e par les chambres r\u00e9unies (<em>Sezioni Unite<\/em>) dans l\u2019arr\u00eat n\u00b0 4844\/1994, selon laquelle un licenciement disciplinaire prononc\u00e9 sans le respect des garanties proc\u00e9durales est \u00ab simplement d\u00e9pourvu de justification \u00bb et non nul.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Cour souligne \u00e9galement que le l\u00e9gislateur a d\u00e9lib\u00e9r\u00e9ment instaur\u00e9 un syst\u00e8me gradu\u00e9 de protection, fond\u00e9 \u00e0 la fois sur la gravit\u00e9 de l\u2019irr\u00e9gularit\u00e9 constat\u00e9e et sur la taille de l\u2019entreprise. Dans le r\u00e9gime du contrat de travail \u00e0 protections croissantes (<em>contratto a tutele crescenti<\/em>), r\u00e9gi par le d\u00e9cret l\u00e9gislatif n\u00b0 23\/2015, la protection r\u00e9int\u00e9gratoire en cas d\u2019inexistence du fait disciplinaire est pr\u00e9vue \u00e0 l\u2019article 3, paragraphe 2. Toutefois, l\u2019article 9, paragraphe 1, du m\u00eame d\u00e9cret pr\u00e9voit express\u00e9ment que cette protection \u00ab n\u2019est pas applicable \u00bb aux employeurs dont l\u2019effectif est inf\u00e9rieur au seuil l\u00e9gal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La Haute juridiction en d\u00e9duit qu\u2019\u00ab en pr\u00e9sence d\u2019une petite entreprise, l\u2019irr\u00e9gularit\u00e9 tenant \u00e0 l\u2019absence de notification des griefs, bien qu\u2019extr\u00eamement grave, ne saurait permettre de contourner le seuil d\u2019effectif par le recours \u00e0 une nullit\u00e9 virtuelle, le l\u00e9gislateur ayant identifi\u00e9 dans l\u2019indemnisation r\u00e9duite le juste \u00e9quilibre entre la protection du salari\u00e9 et les caract\u00e9ristiques organisationnelles propres aux employeurs de petite taille \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En cons\u00e9quence, l\u2019arr\u00eat de la cour d\u2019appel de Naples a \u00e9t\u00e9 jug\u00e9 exempt de toute critique. Apr\u00e8s avoir constat\u00e9 que l\u2019employeur relevait de la cat\u00e9gorie des \u00ab petites entreprises \u00bb, la cour d\u2019appel a, \u00e0 bon droit, limit\u00e9 la r\u00e9paration au seul versement d\u2019une indemnit\u00e9, en excluant la r\u00e9int\u00e9gration du salari\u00e9 dans son emploi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>R\u00e9sum\u00e9 Par un arr\u00eat tr\u00e8s r\u00e9cent (n\u00b0 17283 du 1er juin 2026), la Cour de cassation s\u2019est prononc\u00e9e sur la question de l\u2019absence de notification des griefs disciplinaires et sur ses cons\u00e9quences quant au r\u00e9gime de protection applicable.
