What emerged?
- Clarity in defining objectives is the first form of protection for the employer.
- Case law recognizes the legitimacy of clauses that make bonus payments conditional upon the employee remaining in service on the payment date, provided they are drafted in a clear and unambiguous manner.
- Failure to assign objectives may constitute a breach of contract, with potential compensation implications in terms of loss of opportunity.
