De Luca & Partners is an independent law firm composed of a team of 20 professionals and is one of the most renowned Italian law firms specializing in Labour Law.

The firm was founded in 1976 by Vincenzo De Luca, and in 1998 it became a professional association.

The firm has exclusive experience in the field of labour law and provides legal advice, assistance, and litigation services to national and multinational companies across all sectors, thanks to its expertise in the following areas: labour law, agency law, occupational health and safety, corporate administrative liability (Legislative Decree 231/01), and privacy.

The decision to focus on a specific legal field, taken in the mid-1970s, still represents a central point in the firm’s development strategy.

Thanks to its in-depth knowledge of Italian laws and practices gained over 50 years, as well as its ability to explain clearly and simply the rules (and often complexities) of Italian labour law, the firm is frequently involved in cross-border transactions involving multiple jurisdictions, and advises headquarters, legal affairs directors, and HR managers operating outside Italy.

LAWYERS SPECIALIZED IN LABOUR LAW 

The labour lawyers of De Luca & Partners provide ongoing advice and assistance to client companies in their day-to-day employment relationship management and, more broadly, in all aspects of labour law, including industrial relations, workplace health and safety, agency law, and compliance.

The team of experienced lawyers, each with vertical expertise in a specific field to meet every client’s need with competence and professionalism, assists clients in several areas, including: 

  • Full support in managing corporate crises, including procedures for Ordinary Wage Guarantee Fund (CIGO), Extraordinary Wage Guarantee Fund (CIGS), and solidarity contracts. 
  • Support in the negotiation and drafting of self-employment and quasi-subordinate contracts, and management of the relevant relationships from establishment to termination. 
  • Drafting of employment contracts for all employee categories (blue-collar workers, office staff, middle managers, and executives), including special clauses (e.g., non-compete and retention agreements). 
  • Definition of stock option plans, MBOs, other forms of incentives and retention schemes, and corporate welfare plans
  • Drafting of company policies and internal regulations in employment matters. 
  • Management of all issues related to staff leasing, supporting both temporary employment agencies and client companies. 
  • Assistance with employment disputes, including disciplinary proceedings, individual and collective transfers, changes in job duties or other employment conditions, as well as individual and collective dismissals and any other form of contract termination. 
  • Management of labour litigation, both individual and collective, at all levels of jurisdiction and before all courts, civil and administrative, within the firm’s area of specialization. This includes litigation on behalf of companies, executives, corporate officers, and those who combine an employment relationship with a corporate role. 
  • Drafting of agency and brokerage contracts, as well as assistance in their execution and termination. 
  • Support in business transfers and transfers of business units. 
  • Advice and assistance in all matters related to corporate reorganization and restructuring
  • Assistance with occupational health and safety in compliance with Legislative Decree 81/2008. 
  • Labour law due diligence activities.
