Mobbing

There is no legal definition of mobbing in the Italian legal system, and it is structured over time by case law.

De Luca & Partners has paid particular attention to employment situations which might include mobbing cases. It is appropriate to ascertain circumstances behind mobbing cases which are not based on single injurious acts or multiple unrelated actions. They should be seen as many different, and not necessarily criminal, facts which result in the active subject’s hostility towards the victim. The active subject’s ability to humiliate and isolate the employee from the work environment must be examined.
