On 22 June 2022 the Council of Ministers, definitively approved the draft legislative decree implementing the EU Directive 2019/1152 on transparent and predictable working conditions in the European Union ( “Transparency Decree”). The draft decree introduces new disclosure obligations in addition to the applicable legislation (Legislative Decree no. 26 May 1997, no. 152), which the employer must carry out for employment and staff leasing contracts, business relationships with predominantly personal and continuous services organised under Art. 2, paragraph 1 Legislative Decree no. 81/2015, to contract for continuative and coordinated services referred to in Art. 409, paragraph 1, no. 3 of the Code of Civil Procedure and occasional service contracts, and other types of employment relationship covered by the legislation. The employer must comply with disclosure obligations using individual employment contracts or by providing the employee with a copy of the employment establishment notice. If there is a delay or non-compliance, the employer will be subject to a penalty ranging from €250 to €1,500 for each worker concerned. This will be imposed by the Labour inspectorate (ITL) after the worker has filed a complaint and following an inspection. . The measure introduces important innovations on the following issues: probationary period, job combinations , minimum job predictability, mandatory training and worker protection measures. Publication of the legislative decree in the Official Gazette is awaited.
