INSPECTIONS: MINIMUM CONTENTS OF THE ACCESS MINUTES

Article 33 of Law no. 183/2010 (so called “Labor Attachment”) provides new and compulsory rules for a more correct and clear procedure concerning the inspection activity in the Labor and Social Security Legislation areas. The first innovation regards the inspector’s obligation of providing for the first access minute drafting (so called “verbale di primo accesso”) for each inspection. The mentioned document has to be send at the end of the inspection itself. In addition to the obligation above, another provision concerns the rules about the minute contents, which are mandatory under the penalty of following steps inspection nullification due to the lack of reason. In case of inspection which requires more than one access, the inspector will issue, for each access, an interlocutory minute with the specification of the “in progress” inspection activity.
