The Ministry of Labor, with questioning no. 8/2011, clarified the effects deriving from part-time employment contracts entered into overcoming the limit established by the collective bargaining, providing that the violation of such limit causes the irregularity of the company and the consequent failed issue of the document regarding the contributive regularity (so called “DURC”). The aim of the mentioned rule is to obstruct the work for which no earnings are declared, especially in the building sector where in the last years it has been registered a high increase of part-time working relationship which could presumably cover up partial regularizations of illegal workers, in order to avoid the application of the so called “maxi sanction for irregular work” only.
