The long-awaited Decree of the Ministry of Labour and Social Policies of 15 December 2015 on the ways of communicating dismissals and any termination of the employment by mutual consent was published in Official Gazette No. 7 of 11 January 2016. The new procedure, as expressly provided for under article 26, paragraph 8, of Legislative Decree No. 151/2015, will apply effective as of the sixtieth day following the publication of the Decree. Therefore, effective as of 12 March 2016, in order for any dismissal and termination by mutual consent to be effective, the latter must be electronically communicated through the Government’s Website. This new online procedure will be the only possible one, thus replacing the former procedure defined by the Fornero Law, which was based on validation and which will only remain for some residual cases.
