The introduction of gangmastering among the predicate offences envisaged by Italian legislative decree no. 231 (Newsletter Norme & Tributi – Camera di Commercio Italo-Germanica – Vittorio De Luca, Luciano Vella)

La Legge n. 199/2016, entrata in vigore lo scorso 4 novembre, ha ampliato l’elenco dei reati presupposto di cui al D.lgs. 231/01, introducendo all’art. 25-quinquies la riformulata fattispecie criminale di cui all’art. 603-bis del c.p. Si tratta della cd. “Intermediazione illecita e sfruttamento del lavoro” (cd. reato di caporalato) che punisce non soltanto chi recluta manodopera allo scopo di destinarla al lavoro presso terzi, ma anche chi la utilizza costringendo i singoli a condizioni di sfruttamento, approfittando del loro stato di bisogno. Il legislatore, ponendo l’accento sull’importanza del rispetto delle norme in materia di sicurezza e igiene nei luoghi di lavoro, ha previsto gravi conseguenze per l’ente che non riesca per sua colpa ad evitare che siffatte condotte possano realizzarsi. In particolare, ha previsto, oltre alla comminazione di una sanzione pecuniaria da un minimo di 103.200 ad un massimo di 1.549,000 Euro, l’irrogazione, in caso di condanna, di una delle sanzioni interdittive di cui all’art. 9, co. 2 D.lgs. 231/01, per una durata non inferiore ad un anno, oltreché l’interdizione definitiva dall’attività qualora l’ente, o una sua unità organizzativa, vengano utilizzate al fine prevalente o esclusivo di consentire o agevolare la commissione del reato.
