“AI tools, remote work and confidential data: employer liability in a borderless environment” – IBA Conference 2026

At the IBA Annual Conference 2026 in Copenhagen, our Managing Partner Vittorio De Luca moderated a panel on one of the most pressing challenges facing employers today: the intersection of artificial intelligence, remote work and the protection of confidential business information.

Alongside Anne Morel (BSP, Luxembourg), Vittorio led a discussion with an international panel of employment law practitioners from Europe, North and South America, exploring the legal and operational risks arising from employees’ use of AI tools in increasingly borderless working environments.

The session examined how the use of AI by remote employees can expose organisations to overlapping liabilities under data protection, employment and cybersecurity frameworks, including risks related to unauthorised data processing, trade secret disclosure, regulatory investigations and cross-border compliance issues.

Speakers also shared practical guidance on the governance measures employers should adopt to mitigate these risks, from AI policies and data processing agreements to disciplinary procedures, internal investigations and global compliance strategies.

Session Chairs

Speakers

  • Tommy Angermair, Labora Legal
  • Maria Fernanda Espinosa, Barros & Errazuriz
  • Kohei Wachi, Mori Hamada US LLP
  • Pulina Whitaker, Jones Day

The discussion provided valuable insights into the rapidly evolving relationship between technology, workforce management and employer responsibility in a global workplace.
