FIXED TERM CONTRACT: THREE DIFFERENT DISCIPLINES DEPENDING ON THE HIRING DATE (IL SOLE 24 ORE, JUNE 9, 2014, PAGE 6)

The Law no. 78/2014 came into effect on May 20, 2014 and, consequently, the fixed-term discipline changed three times in 60 days. There are three different disciplines applicable depending on the hiring date: (i) for contracts entered into by March 20, 2014, just one extension is allowed and no administrative sanction has been provided for in case of violation of the 20% threshold. In this circumstance, the employer may not enter into fixed term contracts and has the chance to legalize the position within December 31, 2014; (ii) for contracts entered into between March 21 and May 19, 2014, law provides for up to 8 extensions, while it has still to be clarified whether the administrative sanction must be applied in case of violation of the 20% threshold.Contracts exceeding this threshold are turned into a undetermined contract; (iii) for contracts entered into starting from May 20, 2014, law provides for up to 5 extensions and the sanction regarding the violation of the 20% threshold are enforceable.
