Pay Equity and Transparency: EU Directive No. 2023/970
During our last Team Meeting, among various topics, we presented a report on the latest EU Directive on gender pay equality.
Italian Legislation on Pay Equality
“Female workers have the same rights and, for equal work, the same pay as male workers.”
Legislative Decree No. 198/2006 (as amended by Law No. 162/2021) – Equal Opportunities Code
Objective: Eliminate any discrimination based on gender through incentive measures.
Gender Equality Certification: Granted to companies that implement active policies demonstrating concrete measures to reduce the gender gap in terms of career growth opportunities, equal pay for equal work, gender management policies, and maternity protection.
Benefits:
Improved company reputation
Reduction of employer social security contributions and tax benefits
Competitive advantage in public tenders
Scope – Article 1
Establishes minimum requirements for Member States to strengthen the application of the principle of equal pay for equal work or work of equal value between men and women (“principle of pay equality”).
Member States may introduce more favorable provisions.
Application – Article 2
Employers in both the public and private sectors, with no limits or minimum employee thresholds.
All workers with an employment contract or work relationship as defined by law, collective agreements, and/or national practices.
