Gli strumenti a tutela del Whistleblower all’interno del Modello 231 (Newsletter Norme & Tributi n. 113 – Camera di Commercio Italo-Germanica – Vittorio De Luca, Luciano Vella)

Lo scorso 28 febbraio è iniziato l’esame al Senato del Ddl n. 2208, recante disposizioni per la tutela degli autori di segnalazioni di reati o irregolarità di cui siano venuti a conoscenza nell’ambito di un rapporto di lavoro pubblico o privato (c.d. whistleblowing). La legge, qualora approvata, porterà alla modifica dell’art. 6 D.Lgs. 231/01. In particolare sarà previsto l’obbligo, sia per i soggetti apicali sia per i sottoposti (inclusi i collaboratori esterni), di presentare segnalazioni di illeciti che riterranno essersi verificati all’interno della società o nel suo interesse e/o a suo vantaggio. Il tutto mediante la predisposizione di misure idonee a garantire la riservatezza dell’identità del segnalante, imponendo l’assoluto divieto di atti ritorsivi o discriminatori nei suoi confronti, collegati proprio alla segnalazione effettuata. Tali atti potranno essere denunciati all’Ispettorato Nazionale del Lavoro e alle Organizzazioni Sindacali. L’eventuale licenziamento intimato al soggetto segnalante (o il mutamento di mansioni) sarà, infatti, considerato nullo, in quanto ritorsivo e discriminatorio, a meno che il datore di lavoro non dimostri la sussistenza di legittime ragioni a fondamento del provvedimento.
