Protection of health and safety in the workplace as part of the Legislative Decree no. 231 (Newsletter Norme & Tributi n. 115 – Camera di Commercio Italo-Germanica – Vittorio De Luca, Luciano Vella)

Il modello di organizzazione, gestione e controllo ha, fra gli altri, lo scopo di tutelare l’integrità psicofisica del lavoratore impiegato all’interno di una società. Non per nulla, a seguito dell’introduzione del D.Lgs. 81/08, il legislatore ha arricchito il catalogo dei reati presupposto della responsabilità amministrativa degli enti, facendovi rientrare le ipotesi di omicidio colposo e lesioni gravi o gravissime commesse con violazione delle norme sulla tutela della salute e della sicurezza sul lavoro. Le sanzioni astrattamente configurabili evidenziano la funzione general preventiva sottesa alla volontà del legislatore, prevedendo sanzioni sia interdittive sia pecuniarie per l’impresa. Al fine di evitare il configurarsi delle fattispecie criminose suddette, il datore di lavoro deve far riferimento a quanto stabilito dall’art. 30 D.Lgs. 81/08, il quale prevede che il modello debba essere adottato ed efficacemente attuato, tenendo conto di determinati obblighi giuridici (sorveglianza sanitaria, rispetto standard tecnico-strutturali di legge circa impianti e attrezzature etc.). Di interesse, sul punto, una recente indagine realizzata da Confindustria in collaborazione con TIM, dalla quale è emerso che la maggior parte delle aziende ha deciso di adottare un modello di organizzazione, gestione e controllo proprio a seguito dell’introduzione degli illeciti in materia di salute e sicurezza sul lavoro, al fine di poter beneficiare dell’esimente di cui al D.Lgs. 231/01.
