HR Virtual Breakfast: ‘Equality and pay transparency: what are the new obligations to reduce gender inequality?’ (De Luca & Partners, 21 May 2025)

On Wednesday 21 May, De Luca & Partners organised a new HR Breakfast.

The moderator Vittorio De Luca, Managing Partner, and the speakers Claudia Cerbone, Managing Associate, and Martina De Angeli, Associate, took stock of the latest European Union Directive on equal pay for men and women, illustrating the next steps for employers.

“A general lack of transparency on pay levels within organisations maintains a situation where pay discrimination and gender-based bias risk going undetected or, even if suspected, are difficult to prove. Binding measures are therefore needed to improve pay transparency, to encourage organisations to review their pay structures to ensure equal pay for women and men performing the same or equally valuable work and to enable victims of discrimination to enforce their right to equal pay […]” (see Recital 16, EU Directive No. 2023/970).

It is against this background that the European Union on 10 May 2023 adopted Directive No. 2023/970, which aims to strengthen the application of the principle of equal pay for men and women for equal work or work of equal value through pay transparency and related enforcement mechanisms. The Member States will have to transpose the Directive by 7 June 2026, but it is advisable for companies to start familiarising themselves with the new obligations now, considering the impact they will have on company policies both in the recruitment and onboarding phase and in the management of the employment relationship.
