Statuto del lavoro autonomo, il commento di Vittorio De Luca (Finanza e Diritto, 1 febbraio 2016)

In merito all’approvazione da parte del Governo della prima disciplina organica del lavoro autonomo, annunciata come lo Statuto del lavoro autonomo professionale, Vittorio De Luca, dello Studio De Luca & Partners, commenta: “Anche se l’enfasi riservata dal Governo al nuovo provvedimento appare eccessiva rispetto al suo contenuto effettivo, riteniamo di particolare rilievo la previsione, a favore del lavoratore autonomo, del diritto di sfruttamento economico relativo ad apporti originali e invenzioni realizzati nell’esecuzione del contratto”.

“La previsione della deducibilità delle spese di formazione, sebbene entro limiti ancora particolarmente stringenti, più che una vera novità, costituisce la correzione dovuta di un errore del legislatore fiscale che – per evidenti motivi di gettito – da ormai troppi anni aveva reso parzialmente indeducibili le spese sostenute dai lavoratori autonomi per la formazione professionale”, conclude De Luca.

Sino ad oggi, l’unica disciplina legale del lavoro autonomo era quella fissata dagli articoli 2222 e seguenti del Codice Civile del 1942.
Il nuovo provvedimento viene approvato a pochi giorni dalla abrogazione, ad opera del Jobs Act, del contratto a progetto introdotto dalla Legge Biagi.
In generale, il provvedimento mira a introdurre alcune garanzie minime finalizzate a proteggere il prestatore di lavoro autonomo considerato evidentemente la parte debole del rapporto.
